ffff ) Shall means mandatory. ( ) Significant inndustrial -uUser SIU shall mean: Except as provided in paragraphs (3) and (4) of this Subsection, a Significant Industrial User is means: (a) f A uUser subject to categorical pretreatment standards; or (b) (2) A uUser that: (4-) (D Discharges an average of twenty -five thousand (25,000) gpd or more of process wastewater to the POTW (excluding sanitary, non - contact cooling and boiler blowdown wastewater); (2) ii Contributes a process wastestream which makes up five (5) percent or more of the average dry weather hydraulic or organic capacity of the POTW treatment plant; or (4) iii) Is designated as such by the City on the basis that is has a reasonable potential for adversely affecting the POTW's operation or for violating any pretreatment standard or requirement. (c-)QJ The City may determine that an Industrial User subject to categorical Pretreatment Standards is a Non - significant Categorical Industrial User rather than a Significant Industrial User on a finding that the Industrial User never discharges more than 100 gallons ep r day (gpd) of total categorical wastewater (excluding sanitary, non - contact cooling and boiler blowdown wastewater, unless specifically included„ in the Pretreatment Standard) and the following conditions are met: The Industrial Use prior to the Cit 's finding, has consistent) complied with all applicable categorical Pretreatment Standards and Requirements; ii The Industrial User annually submits the certification statement required in Division 3, Section 17.10 (p)(5)(b) of this Article. [see 40 CR 403.12(g)], together with any additional information necessary to support the certification statement, and iii) The Industrial User never discharges any untreated concentrated wastewater.
