<br />Under no cireumstances shall the City of South Bend- be, or be held responi-
<br />ble for any sum or sums due from sa' d property owner or owners for said work, ov, for
<br />the collection of the same, or for the payment of any bond, bo id s, ee;rtificate or
<br />certIficat --s, issued to said contractor in payment for such work, except for suers
<br />moneys as shall -have actually been received by the City from the assessments for such
<br />improvments, or such moneys,, as said City ,is by said entitled Act and amendements and
<br />supplements thereto required to pay. All proceedings had, and wuo rk done in the making
<br />of said improvement, assessment of property, collections of assessments -and issuance
<br />of bonds therefor, shall be as providers for in said above entitled Aet, and Aets'
<br />amendatory thereof and supplemental thereto.
<br />BE IT FURTHER RESOLVED, That the Board of Public Works fix the l8th. day
<br />of May,1915 _A.D. at the hour of 7:45 P.M. at the office of the 'Board of Public Wo.rizs,
<br />of this City,.as the time and place. for the public eonstlderation of said proposed'im-
<br />provement, at which- said Board. of Public Works -�dll hear all persons interested,or
<br />whose property is liable to -be assessed for said imp-ovement and wi 11 decide whether
<br />the benefits to the property liable to be assessed for said Improvement veil equal the
<br />estimated eost.thereof.

<br />STREET OR ALLEY IMPROVEUINT RESOLUTION N0+375.
<br />Be It Resolved.by the Board of Public Works of`the City o.f South Bend,
<br />J St .__Joseph County, State of Indiana, that it is desired and deemed necessary to
<br />improve Dayton Street from Leer Street to Marine Street as follows,to-wit-
<br />By grading said street from property line to property line; paving the
<br />roadway from curb line to curb line with gravel three (3) inches in depth; curbing the
<br />roadway with -cement curb and constructing a f1ve(5) foot cement walk on both sides of
<br />said -street All as shown on the plans, and in accordance with the plrofiles, detail
<br />drawings, and specifications on -file in the office of the bepartment oX Public Works
<br />of the City of South Bend, Indiana; which are hereby adopted; and such,improvement is
<br />now ordered.
<br />The cost of the improvement herei n provided for, except street and
<br />alley intersections, shall be paid by special assessment to be levied upon the pro-
<br />perty specially benefited to the amount that the same may be legally assessed therefor
<br />in accordance with an Act of tie General Assembly , of the State of Indiana, entitled`
<br />"An Act Concerning. Municipal Corporations, " approved March 6,1905,.' and in accordance
<br />with and pursucant to the provisions_ of all acts amendatory &nd supplemental thereto.
<br />The costof all street and alley intersections includingone-hale
<br />of the width of the improvement Apposite street and alle�rs which run tnto,b,mt do not
<br />cross said roadway herei n proposed to be improved and that portion of such streett
<br />or alley abutting upon property belonging to said City; or upon property not subject
<br />to suds assessment, shall be paid by the City in dash out of its general fund,if
<br />able to do so, or from a fund created by a special assessment to be -levied under the
<br />provisions of.Seetion 109 of the above entitled Act.
<br />Assessment of ten d llars and more against each lot,,if deferred, area
<br />to be #said in ten equal annual installments With interest at the rate of Si7 per cent.
<br />per annum. A bond or bonds vd ll be issued �o the contractor to the amount of such.
<br />deferred assessments in pro rata payment for such improvement.
