<br />jlf j tESOLVED BY THE BOARD OF PUBLIC WORKS OF -THE CITY' O F SOUTH BEND, ST.
<br />JOSEPH COUNTY,STATE OF INDIANA, That it is desired and deemed necessary to improve the
<br />FIRST ALLEY EASE' OF ST. JOSEPH STREET FROM" WAYN'E STREET TO THE FIRST ALLEY SOUTH OF WAYNE
<br />STREET: as follows, to -wit: -
<br />By grading said First Alley east of St. Joseph Street from Wayne Street
<br />to the First Alley south of Mayne Street from property line to property line, and paving
<br />siad Alley its full width, *ithASPHALT,ASPHALTIC ONCRETE,. BITULITHIC ,CREOSOTED WOODEN
<br />BLOCK OR BRICK LAID ON A FIVE INCH PORTAND CEMENT GRAVEL CONCRETE FOUNDATION, or with
<br />Brick laid on a six inch rolled Gravel foundation. Placing the hesessary marginal
<br />eemin.t curb, the construction of the necessary storm water inlets and conduits. All as
<br />showk'en the plans, and in aceordance with the profiles, detail drawings and specifications
<br />on _file. in the office of the Department of Public Works ff said ,City. And such improvEment
<br />is now ordered.
<br />The cost of the improvement herein provided far, except street and alley
<br />intersections , shall be paid by special assessment to be -levied.. upon, the property speci-
<br />ally benefitted to the amount that the same m€y be legally assessed therefor, in
<br />accordance with an Act of the General Assembly of the State of Indiana, entitled " An
<br />Act Concerning Mutticipal Corporations, 0 approVed March 6219052-_anal in accordance with and
<br />pursuant to, the provisions of all acts amendatory and supplemental thereto.
<br />The cost of all street and alley intersections, inelding one-half of
<br />the width of _the improvement opposite street and alleys which run pinto, but do not
<br />cross said roadway herein, proposed to be improved and that portion of such street orzalley
<br />abutting upon property belonging to said City, or upon property not ssub.ject to such assess-
<br />nent, shallbe paid by the City• in cash out of its general fund, if able to de sty, or, f..0
<br />a fund created by a special assessment to be levied undr the previsions of Section 109.
<br />of the above entitled Act.
<br />Asssessments of ten dollars and more against eaeh lot, if deferred, are
<br />to be paid in tek equal annual installments, with i°iterest at the rate of Six per cent
<br />per annum. A bend. or 'bonds wll be issued to the contractor to the amoub,t ofmsuch
<br />deferred assessments in pro rata payment for such improvement.
<br />Under no circumstances shall the City of South Bend be, .or be -held
<br />responsible for any sum ®-- sums due drom said property owner -or owners for said work
<br />or for the collection of the same, or for the payment of any bead, bonds, certificate
<br />or 'bertifica.tes, issued to said Contractor in payment for sual work. -except for such
<br />moneys as shall have actually been received by the City from the a.sst---sments for such
<br />improvement, or such moneys as said City is by sa,dd , entitled Act an.d amendements and
<br />supplements thereto required to pay, All proceedings had, a -id wrk done in the making of
<br />said improvement, assessment of property, collections of assessments s.nd i- suance of
<br />bonds therefor, shill b*e as prov ded for in said above entited Act , a,,�d Acts
<br />amendatory thereof and supplemntal thereto.
<br />BE IT FURTHER RESOLVED, That the Board of Public Works fixed the 4th.o
<br />day of May,1915 at the hour of 7:45 P.M. at the office of the Board of Public @Yorks
<br />of this City, as the time and place for the public consideration of said proposed improve-
<br />ment, at which said Board. of Public Works wll hear all persons ;interested, or whose
<br />property isliable to be assessed for said improvement, and will decide whether the bene-
<br />fits to the property liable to be assessed for said improvement willequal the estimated
<br />cost thereof.
<br />BE IT FURTHER RESOLVED. That notice of the t i e ad place of su da
<br />Public consideration be published and mailed in the manner provided by law. ?notice of
<br />this resolution shall be published on the 5th. day of April,1915 and on the 12th. day of
<br />April,1915 in the South Bend Deily Tribune.
