<br />The Board instructed the Clerk to notify property owners on Portage Avenue
<br />from North line of Morris Park Addition to North line of Section 34 T. 38 N.R. 2 E. that
<br />the improvement of said street at above points .by pipe sewer would be dicussed at meeting
<br />QTITuesday June 30th.,1914 at 7:45 P.M. and a letter ordered sent to those interested to
<br />be present at such meeting.
<br />Clerk instructed to write to Mr. C. N. Wilcoxen of the Chicago, Lake Shore
<br />J & South Bend Ry. Company requesting his to be present at meeting on Tuesday June 30th.,

<br />and Harris Streets.
<br />LOCAL SEWER IMPROVEMENT RESOLUTION NO. 326.
<br />Resolved by the Board of Public Works of the City of South Bend, County of
<br />St. Joseph, State of Indiana; That the construction of a local sewer, intended and ada-
<br />pted only for local use by the property holders whose property abuts, thereon and not
<br />intended or adapted for receiving sewerage from collateral drains, be and the same is
<br />hereby ordered in and along Indiana Avenue from Carroll Street to Miami Street,viz:-
<br />Beginning at the intersection of the center line of Indiana Avenue and the
<br />Bowman Creek Trunk Sewer. Thence west along the center line of Indiana Avenue to the
<br />center of Rush Street with an 18 inch vitrified pipe sewer; thence still west along the
<br />center line of Indiana Avenue to the center of Carroll Street with a 15 inch vitrified
<br />pipe sewer.
<br />Also beginning at the intersection of the center line of Indiana Avenue and
<br />the Bowman Creek Trunk sewer; thence east along -the center line of Indiana Avenue to the
<br />center of Miami Street with an 20 inch vitrified pipe sewer. Together with the necessary
<br />manho&es, inlets, conduits -and house connections to the curb line along the line of
<br />said improvement. All as shown on the plans, and in accordance with the profiles, detail
<br />drawings and specificationa on file in the office of the Department of Public Works of the
<br />City of South Bend, Indiana.
<br />And such improvement is now ordered and said sewer, with all its appur-
<br />tenances shall be constructed innaccordance with the profile and specifications now on
<br />File in the office of the Department of Public Works of said City. The cost of said im-
<br />provement shall be apportioned against and paid by the property holders whose property
<br />abuts thereon, and upon the City of South Berid, if the City is benefited by said improve-
<br />ment, all according to the method and manner provided for in Act of the General Assembly
<br />of the State of Indiana, entitled," An Act Concerning Municipal Corporations," approved
<br />March 6,1905• Assessments, iC deferred, are to be paid in ten equal annual installments,:'
<br />with interest at the rate of Six per cent per annum. A bond or bolds shall be issued to the
<br />.contractor in payment for such work, unless the property owners pay said assessments before
<br />said bond or bonds are issued. Under no circumstances shall the City of -South Bend be or
<br />be held responsible for any sum or sums due from said property ot,ner or owners for said
<br />work, or for the collection of same, or for the payment of any bond or bonds, certi-
<br />ficate or certificates, i.-sued to said contractor in payment for such work, except- Cor such
<br />moneys as shall have been actually received by the City from the assessments for such
<br />improvement, , or such moneys as said City is by said above entitled Act required topay.
<br />All proceedings had, and work done in the waking of said improvement, assessment of pro-
<br />perty, collection of ssessments and issuance of bonds therefor, shall be as provided
<br />for in said above entitled Act.
<br />Notice of this resolution shall be published on the 26th., day of June,1914
<br />and on the 3rd. day of July,1914 in the South Bend Daily Tribune. This Board will give a
<br />hearng on this resolution at its office in the City Hall on the 21st. day of July,1914
<br />at 7:45 P.M.
