2_ 5 <br />The following communication vras received by the Board and placed on file. <br />TO THE HONORABLE BOARD OF <br />PUBLIC WORKS. <br />South Bend, Ind_. <br />Gentlemen:— <br />f I wish to beg permission to cut the curb in front ' of my residence at 920 <br />Sherman Avenue so as to build a drive way to my garage now being built. Trusting that <br />you will grant 3Shis reqest, I thank you, <br />Yours truly, <br />W.J.ALLEN. <br />j The following resolution -was presented to the Board by the Chicago, Indiana & Southern <br />Railroad Company, approved and referred to the Common Council for ratification. <br />BE IT ORDAINED, By the Common Council of the City of South Bend, That the <br />Chicago, Indiana. and: Southern Railroad Company is hereby invested with full power. and <br />authority to construct, maintain and operate an industrial or spur railroad track with— <br />in -the City of South Be -Aid, over, upon and along Wilber Street, as follows: — <br />Beginning at. a point near Where the east line of Wilber Street, if ex— <br />tended, would intersect the main track of the said Chicago, Indiana, <br />& Southern Railroad, thence in a general southwesterly direction a— <br />cross said Wilber Street to the west line thereof, as indicted in the <br />blue print hereto attached and made a part thereof, said track- being in- <br />dicated by lines shown in red. <br />This grant is made upon the egpress condition that where the said <br />track crosses said Wilber Street, it shall be constructed so as to conform to the <br />established grade of said street; and further, that said railroad Company shall plank <br />-the e+vessing of said street between the rails of said track, and for trio (2) feet <br />on either side of said rails. <br />This Ordinance shall be in full force ann' effect from and after its passage <br />and acceptance by said Railroad Company. <br />The above blue print referred to was approved by the Board on April 28th. ,1914. <br />President. <br />
