Resolution No. 2170 <br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION <br />ACCEPTING THE TRANSFER OF REAL PROPERTY <br />FROM THE CITY OF SOUTH BEND, INDIANA <br />WHEREAS, the City of South Bend, Indiana (the "City") is the owner of the following <br />described real property situated in St. Joseph County, Indiana: <br />Lots Numbered Thirty-eight (38), Thirty-nine (3 9) and Forty (40) as <br />shown on the recorded Original Plat of the Town, now City of South <br />Bend recorded March 28, 1831 in Plat Book "A", page 13 in the <br />Office of the Recorder of St. Joseph County, Indiana. Key No. 18- <br />3001 -0024 (hereinafter referred to as the Real Property) <br />(collectively hereinafter referred to as the Real Property); and <br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works of the City of South Bend <br />(the "Board") has custody of and may maintain all real property of the City of South Bend; and <br />WHEREAS, the City, through the Board, desires to transfer the Real Property to the City of <br />South Bend, for the use and benefit of its Department of Redevelopment for use in the <br />redevelopment of the South Bend Central Development Area; and <br />WHEREAS, the City of South Bend, Department of Redevelopment, acting by and through <br />its governing body, the South Bend Redevelopment Commission desires to acquire the Real Property <br />from the City of South Bend; and <br />WHEREAS, pursuant to I.C. 36-1-11-8, the City, acting by and through the Board, may <br />exchange or transfer property with another governmental entity upon terms and conditions agreed <br />upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of <br />each entity; and <br />WHEREAS, the Board of Public Works, at its meeting of June 13, 2005 adopted its <br />Resolution No. 2005-46, approving the transfer of the Real Property to the City of South Bend, for <br />the use and benefit of its Department of Redevelopment. <br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEN]; <br />P�EDEVELOPMENT COMMISSION AS FOLLOWS: <br />1.
