No. 2200 approving a form of maintenance service agreement for the elevators in the Wayne St. Parking Garage and other related matters

Plaza Parking Garage (the "Leighton Elevators "), located at 111 S. Michigan Street in the City, which are currently being serviced by another service provider; and WHEREAS, the City desires to have all of its elevators under one contract upon the expiration of the initial term of the Agreement and to have the opportunity to bid or negotiate for an agreement providing maintenance, inspection and repair services for the Covered Elevators and the Leighton Elevators, together, in hopes of obtaining a savings to the City and the Commission; and WHEREAS, the Commission now desires to approve the form of the Agreement with respect to the Commission Elevators and to authorize the President of the Board of Public Works to finalize, execute and deliver the Agreement on behalf of the Commission; and WHEREAS, the Commission further desires to authorize the Board of Public Works of the City to solicit and award a bid or negotiate an agreement providing for maintenance, inspection and repair services for the Commission Elevators following the expiration of the Agreement; NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION AS FOLLOWS: 1. The Commission hereby approves the form of the Agreement presented to the is Board at this meeting, and the Secretary of the Commission is instructed to include a copy of said Agreement with the minutes of this meeting. 2. The Commission hereby authorizes and directs the President of the Board of Public Works to negotiate, execute and deliver the Agreement on behalf of the Commission in the form approved by the Commission, with such changes either in form or substance as may be approved by the President, upon the advice of the redevelopment staff, with such approval to be conclusively evidenced by such execution. 3. The Commission hereby authorized the Board of Public Works to solicit and award a bid or negotiate an agreement providing for maintenance, inspection and repair services for the Commission Elevators. The redevelopment staff is further authorized to advise and assist the Board of Public Works with such process. 4. The redevelopment staff is further authorized to assist the Board of Public Works with any item related to Agreement, the services provided thereunder or the services provided under any subsequent agreement or arrangement negotiated by the Board of Public Works on behalf of the Commission pursuant to this Resolution. 5.
