Kemmerly's time <br /> until September 1, 1931, at which time the Pension Boasd would take <br /> him. <br /> Attorney Sam Fiwell appeared before the Board stating he represented <br /> P��r. Rudolph Summers v�ho attempted to operate a news stand in front of <br /> the Odd Fello�vs Building, corner P�Tain and �r'dashin�ton Streets. Nr. <br /> Fi�vell explained that he was t�ere on behal� of T�:r. Summers and �,�r. <br /> Geor�e Sands caho ovans the building. The Board explained to T:Ir. Fiwell <br /> that they had made a ruling, sometime a�o, against news stands being <br /> established in the loop district of the city, however, �1r. Fiwell <br /> continued to make an wrgent plea to the Board. Attorney Sidney Eder <br /> was also present and protested against the establishment of news . <br /> stands. City Attorney Clements was also present and advised the Boar d <br /> as to their legal rights in the m atter. Chie� Kuespert egplained his <br /> views and sta�ed that he was of the same opiriu�n as the Board and that <br /> � it was absolutely wrong to grand the stand. <br /> After hearing R�r. Fiwell, the Board on motion of r�Tr. Long, seconded <br /> by ?s�r. Gadacz, agreed that the stand should not he established on the <br /> corner and ordered Chief Kuespert to remove stand if' it continues to <br /> remain. <br /> Attorney Iden S. Romig appeared before the Boar d on behal� of some <br /> of his clients, residen ts of George Avenue, stat_ing that they desired <br /> that the Board rule that there be no parking at the dead end of the <br /> street, which he contended was an alley. The Board informed r�r. <br /> Romig that the City Ordin�nce covering same only prohibits the <br /> p�,rkin5 in alle�rs in the vehicular loop and advised him to present <br /> an ordinanee covering same to the Common Council. rEZr. Clements vrho � <br /> was present stated that he would see that the ordinance vras presented <br /> before the Council tonight and upon recommendation of the Board he <br /> agreed to see that the ordinance , which covers the parkin� in alleys <br /> be amended to read that there be no parking in any alley in the City <br /> of South Bend , instead of just vehieular loop as it is notiv. , <br /> The Clerk read the �ollowing charges presented by Chie� Kuespert and <br /> filed v�ith the Clerk �lugust 6, 1931: <br /> r'To the Honorable Board of Public Sa�ety <br /> Gentlemen: I herewith prefer the �ollovain� charges against <br /> Offieer John r.tyers. <br /> That the said officer, John rlyers, ha.s been guilt� of eonduct <br /> unbecoming an of�icer by his careless use of his revolver in <br /> shooting at dogs thereby breaking a plate glass ��indotFa in the ' <br /> premises knovrn as 1702 Prairie bvenue oti�ned by Vincent Kirsits. <br /> Further more that Officer John P.�yers, in a report to me dated <br /> July 15, 1931, es�ablishes �or himself a policy of shooting at <br /> dogs vvithout any consideration for the safety of the public. <br /> Respeet�ully submitted, <br /> John B. O�ficer �:iyers denied the charges o� ' conduet <br /> unbecoming an of�icer� and stated he thought he was v�ithin his rights. <br /> The Board informed him he �vas �Frrong and stated that for his benefit <br /> he might remember that in the future if he had any difficulty v�ith <br /> dogs or any other animals to noti�y the Chief and he would take the <br /> matter up with ?:"r.
