REGULAR MEETING <br />AUGUST 27, 2007 <br />Mr. George Herendeen, Attorney at Law, 419 W. Jefferson Blvd., South Bend, Indiana, <br />made the presentation on behalf of the owner G.V.W. Tire, Inc. <br />Mr. Herendeen advised that the purpose of this vacation is that this strip of property was <br />originally owned by the State of Indiana as part of the Brick Road right-of--way. Some <br />time ago, the State voluntarily conveyed ownership of this wedge of land to the City of <br />South Bend. Effectively, it is the northeast corner of the property owned by the petitioner <br />and is the natural boundary of that property. Mr. Herendeen stated that the petitioner has <br />worked with the City Engineer's office to resolve issues with respect to the property and <br />the City Engineer has joined in the request to vacate this wedge of property to complete <br />the boundary lines of the property presently owned by the petitioner. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Dieter made a motion for favorable <br />recommendation to full Council concerning this bill. Councilmember Varner seconded <br />the motion which carried by a voice vote of nine (9) ayes. <br />BILL NO. 44-07 PUBLIC HEARING ON A BILL OF THE <br />COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, AMENDING CHAPTER 14 <br />OF THE SOUTH BEND MUNICIPAL CODE BY <br />THE INCLUSION OF NEW ARTICLE 9 <br />ENTITLED "REGULATIONS ADDRESSING <br />SPECIAL EVENTS IN RESIDENTIALLY <br />ZONED AREAS" AND AMENDING OTHER <br />SECTIONS OF CHAPTER 14 RELATED <br />THERETO <br />Councilmember Pfeifer made a motion to continue this bill until the September 17, 2007, <br />Special Meeting of the Council for the sole purpose of hearing Bill No. 44-07, and refer <br />back to the Community Relations Committee. Councilmember Dieter seconded the <br />motion which carried by a voice vote of nine (9) ayes. <br />BILL NO. 50-07 PUBLIC HEARING ON A BILL OF THE <br />COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, TO AMEND VARIOUS <br />SECTIONS OF CHAPTER 6, ARTICLE 1, OF <br />THE SOUTH BEND MUNICIPAL CODE <br />ADDRESSING PERMIT FEES AND THE <br />DEFINITION OF PLUMBING CONTRACTOR <br />Councilmember Pfeifer, Chairperson, Personnel & Finance Committee, reported that this <br />committee held a Public Hearing on this bill this afternoon and voted to send it to the full <br />Council with a favorable recommendation. <br />Mr. Donald Fozo, C.B.O., 125 S. Lafayette Blvd., Suite 100, South Bend, Indiana, made <br />the presentation for this bill. <br />Mr. Fozo advised that this bill would allow his department to stay incompliance with <br />Ordinance 8412-93, subsection 1, which established the Consolidated Building <br />Department as an enterprise fund. He stated that it is their responsibility to monitor fees <br />in order to assure that they continue to be self-supporting. He stated that in an effort to <br />keep the Department running with a cash reserve, they have left four (4) positions vacate <br />over the past year. He further stated that he still feels it is necessary to increase the fees <br />
