Contractors bond for the sum of One Thousand ($J,000.00)Dollars signed J by Joseph Zeiger as principal and Henry C. Eckler and J.F. McEndarfer as sureties was a;,)proved by the .Board. LOCAL SEWER IMPROVEMENT RESOLUTION N0. 319. Resolved by the Board of Public Works of the City of South Bend,County Jof St. Joseph, State of Indiana., That the construction of local sewer, intended and a- dapted only for local use by the property holders whose property abuts thereon, and not intended or adapted for receiving sewerage from collateral drains, be and the same is, hereby ordered in and along TALBOT AVENUE TO SOUTH BEND AVENUE TO HOWARD STRFET,viz:- Beginning at the nahole at the intersection of South Bend Avenue and Talbot Avenue thence south on the center line of Talbot Avenue 310 feet with an`12 inch vitrified pipe sewer; thence still south on the centerline of said Talbot Avenue 290 feet to Howard Street with a 10 inch vitrified pipe sewer. Together with the, necessary man- holes, inlets, conduits and house connections to the curb line along; the line of said improvement. AND such improvement is now ordered and said sewer with all its appur- tenances shall b constructed in accordance with the profile ,_end specifications now on file in the office of the Departnent. of Public 'Works of said City.' The cost of said im- provement shall be apportioned against and paid by the property holders whose property abuts thereon, and upon the City of South Bend if the City is benefited by said improve- inent, all according to the .method and manner provided for in Act of the General Assembly of the State of Indiana, eneitlted "An Act Concerning Municipal Corporations," approved, March 6,1905.' .Assessrlents, if deferred, are to be paid in ten equal annual insta i lments with interest at the rate of Six per cent per a.nnum. A bond or bod-s shall be issued to the c ntractor in payment for such work, unless the property owners pay said assessments before said bond or bonds are issued. Under no circumstances shall the City of South Bend be or be :held responsible for any sum or sums due -from said property ojr,F_zer or owners for said work, or for the collection of same, or for he payment of any bond or bonds, certificate or certificates, issued to s_ id. contractor in payment for such work, except for such moneys as shall have been actaully received by the City from the assessments for such improvement, or such moneys as said -City is by said entitled Act required to pay. All proceedings had, : nd work done in the making of said. improvement, assessment of pro- perty, collections of assessr ents and issuance of' bonds therefor, shall be as provided �'or in said above entitled Act.
