220 LOCAL SEWER IMPROVEMENT RESOLUTION NO. 312. ✓ RESOLVED by the Board of Public Works of the City of South Bend., County of St. Joseph, State of Indiana., That the construction of a local sewer, intended and adapted only for ;-local use by the I p rope rty.:, holders,.Whose': property abuts tivreon,, and not intended or adapted for re ceiving sewerage . from collateral drains, be and the same is, hereby ordered in and along TECUMSEH AVENUE FROM PARKOVASH AVTE7,,T1`E TO POKAGONT STREET; viz:- , Begin at the manj.,ole at. the intersection of Parkovash AveTiue and Tecumseli Avenue; thence northerly along the center line of Tecumseh Avenue to t1he center of Pokagon Street with a 15 inch vitrified pipe sewer. Together with the neee ssary man- holes, inlets, conduits and house connections to the curb line along the line of said improvements. All as shown on the plans, profiles and detail drawings on file in the office of thej. Department of Pub 1-i c �.'Ift rks-*. And such improvement is now ordered and said sewer,, with all its appur- I teances shall be constructed in accordance with the profile and speicifeations now on file in the office of the De-Dartnent of Public Works of said City. The cost of said W . L S improvement shall be apportioned against and paid by the property holders whose pro- perty abuts thereon, and upon the City of South Bend if the City is benefited by said improvement, all, according to the method and manner provided for in Act of the General Assembly of the State of indie-aag entitled' "An Act Conerning Municipal Corporations," approved March 621905. Assessments if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annuum. A bond or bonds shall be issued to the contractor in payment for such work, unless the property owners pay said assessments before said bond or bonds are issued. Under no circumstances .shall the City of South Bend be or he held responsible for any sum or -sums due from said property owner or owners for said work , or for the collection of same, or for tia the payment of any bcFnd or bonds, certificate or certificate, issued to said contract; contractor in payment for -such work, except dor such moneys as shall have been actualt received by :he City from the assessments for such improvement, or such moneys as said City is by said above entitled Act required to pay. All proeeed-im'-s had, and work done in the making of'said improvement,, assessment of property, collections of assess - vents and issuance! of bonds therefor, shall be as provided for in said above entitled Act'. Notice of this resolution shall be published on the lst., day of May,1914 and on the Sth., day of 1Aay21914. in the South Daily Tribune.
