Continued., <br />ORDER SELECTING KIND OF MATERIAL <br />Concerning the improvement of the roadway of Cedar Street from <br />Emerick Street to Eddy Street, in pursuance of improvement Resolution No. 295, <br />914 the preliminary order for the improvement heretofore adopted is her ' eby con-, <br />irmed. The Board now orders that so much of t1ie said street be improved with <br />ASPHALTIC CONCRETE and awaeds the contract to RANKERT EGGLESTON they being the lowest <br />and best bidders. <br />E. 11. WEBER <br />The Board made a preli-inary award of the pavenent on Cedar Street <br />from Emerick Street to Eddy Street to Rankert and Eggleston of Asphaltic Concrete, the <br />award expiring on 10;00 A.M. May 2nd.,1914. <br />Petition for curb and walk on Wilber Street between Linden and <br />Michigan Avenue filed with the Board. The same was referred to the City Civil <br />ngineer for investigation. <br />Petition for an opening of Sherman Avenue south to Oak Street <br />presented to the Board. The some was read zmd placed on file. <br />The, following resolution was adopted by the Board* <br />RESOLUTION. <br />Upon motion of John B. Weber, seconded by Arthur H. Rice, the following <br />Resolution was unanimously adopted: - <br />Whereas, on March 25th. 1913, the Board of Public Works of the City <br />of South Bend adopted Condemnation Resolution No. Twenty-three (23), recorded in the <br />Records of said Board of Public Works, in Record No. Four(4) at page 752 for the open- <br />ing of Huey Street in said City, and on March 27th.,,1914 said Board caused to be pre- <br />pared and filed, a list or roll of all the owners or holders -of property, and of all <br />interests therein sought to be taken or to be injuriously effected; also a desckiption <br />of each piece -of property belonging to stash persons and to be taken, or to be effected <br />either beneficially or injuriously. <br />And, Whereas, there was a defect and error in making said list in tl)P--t <br />the property of one person affected by said resolution was incorrectly described, and in <br />that the property of a certain other person was,not included in said list. <br />Therefore, in pursuance to Section 8703 of Burnt Revised Statutes of <br />1914, and in pursuance to all other laws of the State of Indiana in relation to said <br />subject, said assessment list is hereby corrected and it shall bb as follows: - <br />The description of the property of Jacob Andrzysiak shall be: - <br />Six (6) acres of east end of ten (10) acres off west end in W-1/2 of N. <br />E. 1/4 T. 37 N.R. 2 E. except one acre off of west end; and his damages are assessed at <br />0175.00, and his benefits are assessed at $150-00. <br />The property of Telesfor Andrzysiak effected by said condemnation res6lu- <br />is as follows: - <br />Begin three (3) rods east df the north-west corner of the north-east one <br />fourth (1/4) Section 3 T. 37 N.R. 2 E. thence east eight (9) rods; thence south twenty <br />(20) rods; thence west eight (9) rods; thence north twenty (20) rods t6 beginning.r,-> <br />1 acre; and his damages are assessed and fixed at the sum of $175-00, and. his benefits <br />at the sur, of 9150.00 <br />And the Clerk o:' said Board is directed to issue notices as required <br />by law upon said Jacob Andrzysiak and Telesfor Andryzsdak.) notify_ng them thet'on <br />May 5th.2 1914 at 7:45 P.M. said Board will hear any remonstrance which they or either <br />of them may desire to present in regard to the amount of their award of damages, or bene- <br />fits as a-foresaid. <br />E. 141.
