<br />Resolved by the Board of Public forks of the City of South Bernd,` St.
<br />Zostph County, State of IAdiaxa,, That it is deemed necessary to improve FRANCIS
<br />STREET from FIRST A!'jLEY ;SOUTH OF SORIN STREET TO MADISON STREET BY THE CONSTRUCTION1 OF
<br />CEMENT SIDEWALKS AND CFJAENT CURB ON BOTH SIDES OF SAID FRATTCIS STREET, where the
<br />same is xot already constructed.
<br />And Suchimprovement is now ordered, -in accordance withthe profile, de-
<br />tails, drawings and sped:ifcations on file in the office of the Department of the
<br />Board of Public Works of, said City; and such improvement is now ordered.
<br />The cost of saic. improvement, including the cost of street and. alley
<br />intersections,' shall be assessed upon the real estate abutting on said Francis Street,
<br />all according to the method and manner provided for in an Act of the General Assem--�'
<br />bly of t'"�e State of Indiana, entitled "An Act Concerning Muniepal Corporations,
<br />approved March 6,1905, and in accordance with and pursuant to the provisions of all
<br />amendatory and supplemental acts _thereto, passed by the General Assembly of the
<br />State of Indiana. Assessments, if deferred, are to be paid in ten equal annual
<br />installments with interest at the rate of Six per cent Per annum. A bond or bonds
<br />shall be issued to the contractor in payment of such work, unless the property
<br />owners pay said assessment before -said bond or bonds are issued: Under no c6r-
<br />cumstances shall the City of South Bend, be, or be held responsible for any sum or
<br />sums, due from said.property owner or oi,4hers dor d.aid work or for the collection
<br />of the* same, or for.the paymzent of any bond, bonds, certificate or certificates,
<br />issued to said contractor in payment for such work, except for such moneys as shall
<br />have been actually received by the City from the assessments for such improvements.
<br />or such moneys as said City is by said above entitle Act required to pay. All
<br />proceedings hAd, and work done in the making of said improvement, assessment of pro-
<br />perty, collection of assessments and issuance of bonds therefor., shall be as pro-
<br />vided for in said above entitled Act and .amendments thereto.
<br />Notice of this resolution shall be published on.the 25th., de,,y of
<br />March 191.4 and on the lst. , day of April 1914 in the South Bend Daily Tribune. This
<br />Board will give a hearing on this resolution in its office in the City, Hall on the
<br />21st., day .of April ,1914 at 7:45, P.M.
