<br />SIDEWALK IMPROVEMENT RESOLUTION NO. 269.
<br />Resolved by the Board of Public Works of the City of South Bend,St.
<br />Joseph County, State of Indiana, That it is deemed necessary to improve KENWOOD AVENH
<br />FROM OLIVE STREET TO KALEY STREET.
<br />By grading the said street from property line to property line and
<br />constructing cement- walks and cement curbs on both sildes of said Street in accordance
<br />with the profile, details, drawings and specifications on file in the office of the
<br />Department of the Board.. of Public Works of said City; and such improvement is now
<br />ordered.
<br />The cost of said Improvement 9 including the cost of street and alley in
<br />tersections, shall be assessed upon the real estate abutting on. said KENWOOD AVENUE
<br />all according to the method and manner provided for in an Act of the General Assem—
<br />bly of the State of Indiana, entitled. "An Act Concerning Municipal Corporations,"
<br />approved March 6,1905, and in accordance with and pursuant to the provisions of all'
<br />amendatory and supllemental acts thereto, passed by the General Assembly of the State
<br />-of Indiana. Assessments, if deferred, are to be paid in tea equal annual installment
<br />with interest at the rate of Six per cent per annum. A bond. or bonds shall be is—
<br />sued to the contractor in payment of sue vmrk, unless the property owners pay said
<br />assessment before said bond or bonds are issued, Under no circumstances shall the
<br />City of South Bend, be, or be held responsible for any sum or sums, due from said
<br />property owner or owners for said work or for the. collection of the same, or for the
<br />payment of any bond, bonds, certificate or certificates, issued to said contractor
<br />in payment for such• work, except for such moneys as. shall have been actually ree—
<br />eived by the City -from the assessments for such improvement, or such moneys as said
<br />City is by said above entitled Act required to pay. All proceedings had, and work
<br />done in the making of said improvement, assessment of property, collection of assess—
<br />trients and issuance of bonds therefor, shall be as provided for in above- entitled Act
<br />and amendments thereto.
<br />Notice of this resolution shall be published on the 24th. day of
<br />May,1913 and on. the 31st., day of May,1913 in the South Bend Daily Times. This Board
<br />will give a he-azing -on this' resolution: in its offiee;.ia: the City Hall on the 27th.

<br />AVE. FROM OLIVE STREKT TO KALEY STREET.
<br />By grading the said street from property line to property line and
<br />constructing cement walks and cement curbs on both sides of said street, in accord—
<br />anee with the profile, details, drawings and specifications on file in the office of
<br />the Department of the Board of Public Works of said City; and such improvement is
<br />now ordered.

<br />Contractor in paymt-zit for such work, unless the property owners pay said assessment
<br />before said bond or bonds are issued. Under no circumstances shall the City of
<br />South Bend, be, or be held, responsible for any sum or sums, due from said property
<br />owner or owners for said work or for the collection of the same, or for the pay —
<br />anent of any bond,bonds, certificate or certificates, issued to said contractor in
<br />payment for such work, except Por such moneys as shall have been actually received
<br />by the City from the assessments for such improvement, or such moneys as said City
<br />is by said above entitled Act required to pay. All proceedings had, and work done in
<br />the making of said improvement, assessment of property, collection of assessments
<br />and issuance of bonds therefor, shall be as provided -for in said above entitled
<br />Act and amendment thereto.
<br />Notice of thiS resolutIon shall be published on the 24th. day of
<br />May4913 and on the 31st. , day of May,1913 in the South Bead Daily Times. This Board
<br />will give a hearing on this resolution in its office in the City Hail on the
<br />27th. day of June,1913 at 7:45 P.M.
