REGULAR MEETING <br />JULY 9, 2007 <br />Mr. Nemeth, Area Plan Commission, advised that the Mixed Use allows a mix of land <br />uses not limited to retail but also residential, professional office as where LB Local <br />Business is restricted to Local Business, so it is strictly a commercial zone without <br />residential. <br />Mr. Chris Dressel, Community & Economic Development, 12~` Floor County-City <br />Building South Bend, Indiana, spoke in favor of this bill. <br />Mr. Dressel advised that the Community & Economic Development Department is in <br />favor of this project. It will enhance the area and be an asset to the South Michigan <br />Street Corridor. <br />There being no one else present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Rouse made a motion favorable recommendation <br />to full Council concerning this bill as substituted. Councilmember Dieter seconded the <br />motion which carried by a voice vote of nine (9) ayes. <br />BILL NO. 26-07 PUBLIC HEARING ON A BILL AMENDING <br />THE ZONING ORDINANCE FOR 24.345 ACRES <br />GENERALLY LOCATED BETWEEN ANGELA <br />BOULEVARD/EDISON ROAD AND <br />NAPOLEON STREET, AND APPROXIMATELY <br />200 FEET WEST OF EDDY STREET, AND 700 <br />FEET EAST OF DUEY STREET, EXTENDED, <br />COUNCILMANIC DISTRICT NO. 4 IN THE <br />CITY OF SOUTH BEND INDIANA <br />Kathleen Cekanski-Farrand, Council Attorney read into the record the following rules <br />and procedures for governing the public hearing on Bill No. 26-07: <br />Proposed Rules to Govern Public Hearings on Substitute Bill No. 26-07 <br />July 9, 2007 <br />In light of a Special South Bend Common Council meeting being called for Monday, July <br />16, 2007 at 7:00 p.m., with the sole purpose of being to have further public hearing and <br />3~d reading on Substitute Bill No. 26-07, so that there will be ample opportunity to have <br />information provided and questions asked and answered, the following proposed rules are <br />recommended to govern the Common Council Public Hearings on Substitute Bill No. 26- <br />07. <br />Tonight City Clerk Jolm Voorde will read the title of Substitute Bill No. 26-07 <br />Council Members Kirsits, Chairperson, of the Zoning and Annexation Committee will <br />give a report on the Bill. <br />Report from Area Plan respresentative. <br />The presenter(s) will give their formal presentation (Not subject to a time limit) <br />Initial questions from the Common Council Members will be addressed by the <br />presenter(s). <br />Public Hearing -Those speaking in favor shall provide their name and address for the <br />record. Each speaker is limited to a maximum of five (5) minutes. Total time of those <br />speaking in favor shall be noted by the Chair. <br />Public Hearing -Those speaking in opposition shall provide their name and address for <br />the record. Each speaker is limited to a maximum of five (5) minutes. Total time of <br />those speaking in opposition shall be equal to the time spent in favor of or 30 minutes, <br />whichever is greater. <br />
