REGULAR MEETING <br />MAY 11, 1981 <br />He stated that his company had done many studies on potential liability problems caused <br />by the erection of signs along streets and highways, and there were many cases where <br />lack of signs caused lawsuits, and practically no cases were involved as a result of <br />a sign being placed in the right -of -way. Mr. Hill stated that he appreciated Mr. <br />Yarger's comments; however, he was extremely concerned about the potential liability <br />of the city and the placement of the sign in the wrong place which could create the <br />liability problem. Mr. Yarger stated that he felt sure the Board had an interest in <br />the safety of its community. Another representative from Memorial Hospital advised <br />the Board that considerable study and research had gone into this matter on the part <br />of the hospital because the staff felt there was a serious problem regarding the <br />emergency directional signage. It was noted by a representative from North American <br />Signs that the state had been under the impression the signs were already installed <br />since it had given approval previously. Mr. McGann asked when the Board would make <br />its decision on the matter, and Mr. Hill stated that, hopefully, the Board would be <br />able to make a site visit during the week and take final action at its next regularly <br />scheduled meeting. <br />FILING OF ASSESSMENT ROLL - VACATION RESOLUTION NO. 3508, 1981 (SUNNYMEDE THIRD <br />ADD IT I OiV ) <br />John E. Leszczynski, City Engineer, filed an Assessment Roll with respect to <br />Vacation Resolution No. 3508, 1981, for the vacation of the first 14' north -south <br />alley east of Sunnyside running north from Wall Street to the projected south right - <br />of -way line of the east -west alley for a distance of 128.1' between Lots 694 and 693 <br />of Sunnyside Third Addition to the City of South Bend. The following property may be <br />injuriously or beneficially affected by such vacation: <br />Lots 693 and 694 of Sunnyside Third Addition to <br />the City of South Bend <br />The Assessment Roll lists $0.00 net damages and $0.00 net benefits to the abutting <br />properties. Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, <br />the Assessment Roll was filed and set for public hearing on June 8, 1981. <br />REQUEST TO CONDUCT MARCH PROTESTING PRESIDENT'S ECONOMIC POLICY <br />Mrs. Marece Neagu appeared before the Board and requested permission to hold a <br />march on May 17, 1981, to protest President Reagan's economic policy since the <br />President would be the commencement speaker at the University of Notre Dame and <br />would be in town on that day. She stated that her group was anticipating several <br />busloads of people from Chicago, Indianapolis and Detroit, in addition to any local <br />people who wanted to be involved'in the march. She stated that hopefully there <br />would be no disruption of traffic flow and she and her designees would try to see <br />that that would not happen. The plans for the march called for the gathering of the <br />protestors in Leeper Park and a march north on Michigan Street on the west side of the <br />street to Angela and then east on Agenla to Notre Dame. Mrs. Nague stated that the <br />sidewalks would be used for the march. Mr. Hill stated that the Board could not <br />give approval of the march because of the other numerous responsibilities which must <br />be taken into consideration regarding traffic control and general police functions <br />in other areas on that same day. He recommended that the group proceed to the <br />university from Leeper Park on the sidewalks and obey all traffic rules and regu- <br />lations. He pointed out that three major intersections would need to be crossed, <br />and police manpower would not be available to help at those locations. He asked <br />Mrs. Nague work with the South Bend Police Department and Chief Thompson and his <br />designees in order to coordinate the activity, and also that Mrs. Nague work with <br />Notre Dame officials and the county police regarding the entering of another juris- <br />diction other than the city. He asked if consideration had been given as to where <br />all the busses and cars would be parked which would be bringing in the protestors. <br />Mrs. Nague stated that someone had suggested the busses and cars park at the Toll <br />Road entrance as on football game days and then pick up their riders after the <br />protest at Notre Dame Avenue and Angela. Mrs. Nague stated that a minimum of <br />1,000 people were expected. <br />REQUEST TO CONDUCT ROAD RUN - OSTEOPATHIC HOSPITAL AND BETHEL COLLEGE <br />A request from the South Bend Osteopathic Hospital to conduct a road run on Saturday, <br />August 19, 1981, starting at 9:00 a.m. was received.
