REGULAR MEETING MAY 11, 1981 <br />Mr. Leszczynski commented that it was apparent the alley was being used as a buffer <br />zone to, separate the residential properties from the commercial. He stated that <br />it was a rather long through alley which runs parallel to Mishawaka Avenue, and is <br />used as access by the residents. He stated that, during the tour of the area, the <br />Board had noticed that all of the surrounding properties were very well kept up <br />and it was evident there was considerable pride in the neighborhood. He pointed <br />out that, while the city may have no objection to an alley vacation prior to <br />public hearing, the input the Board receives from the residents is weighed heavily <br />prior to a determination. Mr. Hill stressed that the Board could not get involved <br />in the issue of rezoning. He felt it had been helpful for the Board to look at <br />the area, including the blocks to the east and west and see how those alleys were <br />laid out in relation to the entire alley system in the area. He stated that the <br />alley in question is a borderline for the commercial property and the residential <br />area which begins immediately south of the alley system. Based on the concerns <br />expressed by the residents, he stated that he had his doubts that taking away the <br />buffer strip and vacating the alley would not cause inconvenience to the surrounding <br />property owners. He felt the general inconvenience would occur based simply on the <br />extension of potential commercial uses south of the alley system. He stated that <br />the alley definitely served as a line separating existing commercial property from <br />residential. He was impressed by the way the properties in the area were maintained, <br />and he stated that he was concerned with the continued integrity of the neighborhood <br />and the compatibility of uses. He pointed out that the Nursing Home property was <br />also exceptionally well maintained, and it appeared the Nursing Home was a good <br />neighbor, however, even if the Nursing Home continued to upkeep its property and be <br />a good neighbor, the vacation of the alley would create problems in the neighborhood <br />through no fault of the Nursing Home. Upon a motion made by Mr. Kernan, seconded by <br />Mr. Leszczynski and carried, the vacation of the first east -west alley south of <br />Mishawaka Avenue between 26th and 27th Street, was denied. <br />APPROVE CHANGE ORDER NO. 5 (REVISED) - ORANGE - COLFAX CONNECTOR (RIETH -RILEY <br />CONSTRUCTION COMPANY) VV` <br />Mr. Leszczynski stated that a revised Change Order No. 5 was being submitted by <br />Rieth -Riley Construction Company for work on the Orange - Colfax Connector. He stated <br />that the original contract price was $2,135,564.59 and the revised contract amount, <br />including change orders was now at $2,162,622.44. Upon a motion made by <br />Mr. Leszczynski, seconded by Mr. Kernan and carried, the change order was approved <br />and forwarded to the State for concurrence. <br />AWARD BIDS AND SEEK PERMISSION TO RE- ADVERTISE PORTION OF PROJECT (FIRST BANK CENTER <br />SITEWORK PROJECT <br />Mr. Leszczynski advised that Mr. Patrick M. McMahon, Director of the Department of <br />Redevelopment, and Mr. David E. Jahn, Project Manager for Sollitt Construction Company, <br />were submitting their recommendations concerning the bid award for various packages <br />for the First Bank Sitework Project. Upon a motion made by Mr. Leszczynski, seconded <br />by Mr. Kernan and carried, the following bids were awarded as recommended, and per- <br />mission was given to re- advertise for interior landscaping (Bid Package #125 -b) and <br />paving (Bid Package #127): <br />Brown and Brown <br />Bid Package #124 <br />Concrete Work <br />Hunziker, Inc. <br />Bid Package #125 -a <br />Landscaping Exterior <br />Ritschard Brothers <br />Bid Package #126 <br />Fine Grading and Shaping <br />St. Joseph Valley Structural Steel <br />Bid Package #129 <br />Metal Fabrications <br />$99,900.00 <br />$88,736.00 (to include substitute <br />of various greenery) <br />$14,000.00 <br />$56,360.00 (to include alternate <br />for handrail) <br />The above bid awards were made subject to the filing of the appropriate Performance <br />Bond, Labor and Materials Payment Bond and Certificate of Insurance. <br />1 <br />1 <br />
