REGULAR MEETING <br />APRIL 27, 1981 <br />them to have access to their garage should the alley be vacated. <br />Mrs. Kincaid advised the Board that last year, the Nursing Home <br />had purchased a house at 925 South 26th Street. She explained <br />how the actual purchase had come about, saying that the owners <br />had not wanted to sell to the Nursing Home even though they had <br />made an offer, and had instead sold the home to a Don Mickles who, <br />later it was learned, had a part in Cardinal Enterprises which one <br />of the principals of the Nursing Home owned. She stated that that <br />same day, the property was purchased by the Nursing Home. Mr. Hill <br />cautioned that the Board was not considering property acquisition <br />and how it came about, but was concerned with the vacation of the <br />alley and the problems its closing would cause to the surrounding <br />residents. Another woman in the audience asked about the rezoning <br />and wondered where it would stop. Mr. Hill again stated that the <br />Board was not involved in the issue of the rezoning and could not <br />confront that matter since the Area Plan Commission and Common <br />Council had jurisdiction. He stated that the Board must direct its <br />comments and action to the vacation of the alley only. He stated <br />that rezoning was automatic and that subsequent hearings by the <br />Council and Plan Commission would be held, at which time those <br />residents concerned should make their comments and feelings known. <br />Mrs. Beck asked if the city had a policy of vacating all alleys when <br />petitioned so it would not be responsible for maintenance, as Mrs. <br />Harter had stated. Mr. Leszczynski stated that that was not the <br />case and that every individual vacation is looked at separately by <br />the Engineering Department, Community Development Department and <br />Area Plan Commission. Only when all reports are received in favor <br />of the vacation is the alley recommended for vacation, and, even then, <br />a hearing must be held to determine if there is any objection to the <br />vacation by the surrounding residents. <br />It was decided that the Board would make an inspection of the alley in <br />question and continue the public hearing to the May 4th meeting of the <br />Board. <br />AWARD BID AND APPROVE CONTRACT - H. DeWULF MECHANICAL CONTRACTORS <br />(HAWBAKER STREET SANITARY SEWER PROJECT) <br />Mr. Leszczynski advised that the Bureau of Public Construction was <br />recommending that H. DeWulf Mechanical Contractors be awarded the <br />Hawbaker Sanitary Sewer Project based on their low bid of $31,695.00, <br />which bids were received by the Board on April 20, 1981. Upon a motion <br />made by Mr. Leszczynski, seconded by Mr. Kernan and carried, the low <br />bid of H. DeWulf Mechanical Contractors in the amount of $31,695.00 <br />was awarded, and the contract for the above work was executed and <br />approved. It was noted that the Performance Bond, Labor and Materials <br />Payment Bond and required Certificate of Insurance had been filed for <br />the project <br />AWARD BIDS - STREET MATERIALS <br />Mr. Sean Watt, Director of the Division of Transportation, submitted <br />his recommendation to the Board concerning the award <br />of the street <br />materials bids which were received <br />by the Board on <br />April 13, 1981. <br />Upon a motion made by Mr. Kernan, <br />seconded by Mr. <br />Leszczynski and <br />carried, the street materials bids <br />were awarded as <br />follows: <br />Walsh & Kelly <br />*Rieth -Rile <br />HAC Surface Limestone <br />$19. 5 ton <br />.20 ton <br />HAC Surface B.F.
