REGULAR MEETING <br />JANUARY 19, 1981 <br />into the state right -of -way. Mr. Hill further stated that the Depart- <br />ment of Redevelopment held the lease with Rahn Properties for the <br />hotel structure; therefore, the property should be conveyed to <br />Redevelopment. Subsequently, Redevelopment would grant an easement <br />to the city and Rahn Properties. Upon a motion made by Mr. <br />Leszczynski, seconded by Mr. Hill and carried, the following <br />Resolution No. 2, 1981, was adopted: <br />RESOLUTION NO. 2, 1981 <br />APPROVING CONVEYANCE OF PROPERTY <br />WHEREAS, the City of South Bend by its Board of Public Works <br />on November 24, 1980, accepted a Quit Claim Deed in favor of <br />said City conveying title to certain portions of State Road <br />33 and U. S. 20 commonly known as St. Joseph Street and Colfax <br />Avenue respectfully, <br />WHEREAS, said conveyance to the City of South Bend by the State <br />of Indiana was made necessary as a result of the construction <br />of the hotel portion of the First Bank /Marriott Project causing <br />underground encroachments into the conveyed portions of State <br />Road 33 and U. S. 20, <br />WHEREAS, the City of South Bend Department of Redevelopment on <br />October 16, 1979, entered into a Ground Lease Agreement For <br />Private Redevelopment with Rahn. Properties II for the rental of <br />that portion of the First Bank /Marriott Project property on <br />which the hotel structure is being built, <br />WHEREAS, said Department of Redevelopment as lessor to Rahn <br />Properties II intends to grant an easement to the City of South <br />Bend for purposes of said City granting an easement over said <br />encroachment areas to Rahn Properties II, <br />WHEREAS, the City of South Bend Department of Redevelopment <br />will hold and maintain said property for public use and purposes <br />and has agreed to accept said property under the provisions of <br />I.C. 5- 18 -1 -1, <br />NOW THEREFORE, BE IT RESOLVED, that the City of South Bend <br />through its Board of Public Works does hereby approve the <br />conveyance of the following described real estate situated in <br />St. Joseph County, State of Indiana to the South Bend Department <br />of Redevelopment: <br />ST. JOSEPH STREET (ST.RD. #33) <br />Beginning at a point on the Easterly line of Lot 3 <br />of the recorded plat of River Bend Addition to the <br />City of South Bend, Indiana as recorded in the <br />office of the Recorder of St. Joseph County, <br />Indiana in Plat Book 31, Page "R ", at a distance <br />of 24.43 feet South 200- 25' -28" East from the <br />Northeast corner of said Lot 3; thence North 840- <br />00'-01" East, a distance of 13.27 feet; thence South <br />50- 59' -59" East, a distance of 4.50 feet; thence <br />South 840- 00' -01" West, a distance of 9.50 feet; <br />thence South 50- 59'59" East, a distance of 10.14 <br />feet to said Easterly line of Lot 3; thence North <br />200- 25' -28" West, along said Easterly line, a <br />distance of 15.12 feet to the place of beginning <br />containing 70.3 square feet more or less. <br />I <br />1 <br />1 <br />
