REGULAR MEETING JANUARY 19, 1981 into the state right -of -way. Mr. Hill further stated that the Depart- ment of Redevelopment held the lease with Rahn Properties for the hotel structure; therefore, the property should be conveyed to Redevelopment. Subsequently, Redevelopment would grant an easement to the city and Rahn Properties. Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, the following Resolution No. 2, 1981, was adopted: RESOLUTION NO. 2, 1981 APPROVING CONVEYANCE OF PROPERTY WHEREAS, the City of South Bend by its Board of Public Works on November 24, 1980, accepted a Quit Claim Deed in favor of said City conveying title to certain portions of State Road 33 and U. S. 20 commonly known as St. Joseph Street and Colfax Avenue respectfully, WHEREAS, said conveyance to the City of South Bend by the State of Indiana was made necessary as a result of the construction of the hotel portion of the First Bank /Marriott Project causing underground encroachments into the conveyed portions of State Road 33 and U. S. 20, WHEREAS, the City of South Bend Department of Redevelopment on October 16, 1979, entered into a Ground Lease Agreement For Private Redevelopment with Rahn. Properties II for the rental of that portion of the First Bank /Marriott Project property on which the hotel structure is being built, WHEREAS, said Department of Redevelopment as lessor to Rahn Properties II intends to grant an easement to the City of South Bend for purposes of said City granting an easement over said encroachment areas to Rahn Properties II, WHEREAS, the City of South Bend Department of Redevelopment will hold and maintain said property for public use and purposes and has agreed to accept said property under the provisions of I.C. 5- 18 -1 -1, NOW THEREFORE, BE IT RESOLVED, that the City of South Bend through its Board of Public Works does hereby approve the conveyance of the following described real estate situated in St. Joseph County, State of Indiana to the South Bend Department of Redevelopment: ST. JOSEPH STREET (ST.RD. #33) Beginning at a point on the Easterly line of Lot 3 of the recorded plat of River Bend Addition to the City of South Bend, Indiana as recorded in the office of the Recorder of St. Joseph County, Indiana in Plat Book 31, Page "R ", at a distance of 24.43 feet South 200- 25' -28" East from the Northeast corner of said Lot 3; thence North 840- 00'-01" East, a distance of 13.27 feet; thence South 50- 59' -59" East, a distance of 4.50 feet; thence South 840- 00' -01" West, a distance of 9.50 feet; thence South 50- 59'59" East, a distance of 10.14 feet to said Easterly line of Lot 3; thence North 200- 25' -28" West, along said Easterly line, a distance of 15.12 feet to the place of beginning containing 70.3 square feet more or less.
