REGULAR MEETING NOVEMBER 10, 1980 <br />a television camera to make sure that there was no settling of the <br />pipe itself. As a result of that check, it had been determined that <br />there was no breakage of pipe or settlement of same. He advised <br />the residents that they may have some additional settlement in the <br />lawn areas over the winter months, and he stated that O'Neal would <br />be taking care of this. Mr. Young stated that the residents had <br />been told previously that O'Neal would be held responsible for <br />the problems he had created, but he and the other residents were <br />not satisfied with the work done thus far. He did not want to <br />see the residents being faced with another Barrett Law project <br />to correct the problems created by O'Neal on the sewer construction. <br />Mr. McMahon stated that the report he had received from the <br />Engineering Department indicated that all the settlement that <br />had occurred had been corrected by O'Neal. He advised the residents <br />that O'Neal had been required to furnish a three -year maintenance <br />bond for the work done on the project and that he would be respon- <br />sible for any resultant damage during that period of time. Mr. <br />McMahon stated that the city has not identified any additional work <br />that needed to be done. He stated that the project did not include <br />reconstruction of all curbs but only those curbs which had been <br />damaged by O'Neal. Mr. Young still maintained that all the sidewalks <br />had been damaged by O'Neal and not all of them had been replaced. <br />Mrs. Lorraine Hildebridle stated that she owned property in the <br />1700 block of Phillipa and she felt that her sidewalks were in <br />relatively good condition prior to the start of the sewer project. <br />She stated that she had previously been advised that her sidewalks <br />would be replaced. She felt the city was hedging on the project. <br />Mr. Young stated that there was a cave -in on Mrs. Hildebridl.e's <br />property and that the Engineering Department personnel had advised <br />that the problem would be taken care of and checked into. He stated <br />that all that was done was to fill the hole with dirt and nothing <br />had been done to determine what the problem was. He felt it. would <br />be a continual problem for Mrs. Hildebridle. Mr. Leszczynski, in <br />response to the complaints regarding the sidewalks, stated that he <br />had personally inspected the sidewalks before the project had been <br />started and many of them were in a deteriorated condition at that <br />time. Mr. McMahon stated that it has been the intention of the <br />city to construct the sewers and leave the residents with a project <br />that would not affect those areas not included in the project. <br />Regarding the sidewalks, he stated that the city had walked through <br />the area and viewed the walks before construction and after and, <br />if the condition of the sidewalks changed substantially and, in <br />certain areas that was the case, O'Neal had been instructed to repair <br />and /or replace them. He stated that, according to an inspection, the <br />rest of the sidewalks were not in any worse condition at the end of <br />the construction. Mr. McMahon stated that the Board of Works members <br />would be willing to walk the area and view the project in order to <br />better understand the complaints of the residents. He stated that <br />the city did not want to force something on the residents which they <br />objected to, and he wanted to be able to understand the basis of <br />their complaints. Mr. Young again brought up the damaged sidewalks <br />and asked the Board members to look particularly in the area of the <br />1700 block of Phillipa. Mr. Hill stated that it was obvious that <br />the project had been a frustration to the city and the residents <br />and that the city wanted to resolve the matter to everyone's satis- <br />faction. He stated that the statement had been made that the city <br />had no intention of remedying the problems and he objected to that, <br />and stated that it was not true. He pointed out that the Board <br />had thought the citizens' problems had been resolved. He stated <br />that he was very willing to go out and look at the area in order <br />to be responsive to the residents. Mr. Young talked briefly about <br />all of the problems the residents had experienced with the project, <br />including the fact that the project was supposed to have been <br />completed last November. He also felt there were changes made in <br />the original plans concerning the sidewalk construction and some of <br />the sidewalk construction work had not been done. <br />
