REGULAR MEETING JUNE 23, 1980 APPROVE RECOMMENDATION FOR DENIAL OF TAXI CAB LICENSE - JOHN T. BREISCH Upon a recommendation received by City Controller Joseph E. Kernan, Mr. McMahon made a motion to deny the license application of John T. Breisch, seconded by Mr. Hill and carried. The Clerk was instructed to advise Mr. Breisch of the Board's decision and inform him of his right to appear before the Board to discuss the matter. APPROVE ENCROACHMENTS - FIRST BANK CENTER Mr. McMahon submitted to the Board six easements, the documents of which had been prepared by Lang, Feeney and Associates, for First Bank Center encroachments as follows: Rahn II easements: Michigan Street Washington Street St. Joseph Street (S.R. 33) Colfax Avenue (U.S. 20 and St. Joseph Street (S.R. 23) FBT Bancorp easements: Michigan Street Washington Street Mr. McMahon explained that these easements were prepared for the purpose of permitting the below.grade encroachment of certain physical appurtenances associated primarily with the garage portion of the Center. These encroachments have been reviewed by the Engineering Department and found to be proper. Mr. McMahon further advised that he would make contact with the Indiana State Highway Commission with regard to those areas involving U. S. 20 and S. R. 33. Upon a motion made by Mr. McMahon, seconded by Mr. Hill and carried, the above easements were granted and approved. ADOPTION OF RESOLUTION NO. 11, 1980 (SALE OF CITY -OWNED PROPERTIES) RESOLUTION NO. 11. 1980 WHEREAS, the Board of Public Works of the City of South Bend has compiled a current detailed inventory of all real property owned by the City of South Bend, Indiana, pursuant to Chapter 14.5 of the Municipal Code of the City of South Bend; and WHEREAS, the Board of Public Works has reviewed said inventory of real property and it now finds that certain of the parcels of real estate now owned by the city are not necessary to the public use and are not set aside by state or city laws for public purposes, pursuant to Chapter 14.5 of the Municipal Code of the City of South Bend; and WHEREAS, the Board of Public Works now wishes to take the necessary action to make it possible for the Board, in the future, to sell said parcels of real estate pursuant to Chapter 14.5 of the Municipal Code of the City of South Bend. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South Bend, Indiana: 1. That the parcels of real estate owned by the city contained in the following list are not necessary to the public use and are not set aside by state or city law for public purposes:
