REGULAR MEETING <br />JUNE 23, 1980 <br />APPROVE RECOMMENDATION FOR DENIAL OF TAXI CAB LICENSE - JOHN T. BREISCH <br />Upon a recommendation received by City Controller Joseph E. Kernan, <br />Mr. McMahon made a motion to deny the license application of John <br />T. Breisch, seconded by Mr. Hill and carried. The Clerk was <br />instructed to advise Mr. Breisch of the Board's decision and <br />inform him of his right to appear before the Board to discuss the <br />matter. <br />APPROVE ENCROACHMENTS - FIRST BANK CENTER <br />Mr. McMahon submitted to the Board six easements, the documents of <br />which had been prepared by Lang, Feeney and Associates, for First <br />Bank Center encroachments as follows: <br />Rahn II easements: <br />Michigan Street <br />Washington Street <br />St. Joseph Street (S.R. 33) <br />Colfax Avenue (U.S. 20 and St. Joseph Street (S.R. 23) <br />FBT Bancorp easements: <br />Michigan Street <br />Washington Street <br />Mr. McMahon explained that these easements were prepared for the <br />purpose of permitting the below.grade encroachment of certain <br />physical appurtenances associated primarily with the garage portion <br />of the Center. These encroachments have been reviewed by the <br />Engineering Department and found to be proper. Mr. McMahon further <br />advised that he would make contact with the Indiana State Highway <br />Commission with regard to those areas involving U. S. 20 and <br />S. R. 33. Upon a motion made by Mr. McMahon, seconded by Mr. Hill <br />and carried, the above easements were granted and approved. <br />ADOPTION OF RESOLUTION NO. 11, 1980 (SALE OF CITY -OWNED PROPERTIES) <br />RESOLUTION NO. 11. 1980 <br />WHEREAS, the Board of Public Works of the City of South Bend <br />has compiled a current detailed inventory of all real property <br />owned by the City of South Bend, Indiana, pursuant to Chapter <br />14.5 of the Municipal Code of the City of South Bend; and <br />WHEREAS, the Board of Public Works has reviewed said inventory <br />of real property and it now finds that certain of the parcels <br />of real estate now owned by the city are not necessary to the <br />public use and are not set aside by state or city laws for <br />public purposes, pursuant to Chapter 14.5 of the Municipal <br />Code of the City of South Bend; and <br />WHEREAS, the Board of Public Works now wishes to take the <br />necessary action to make it possible for the Board, in the <br />future, to sell said parcels of real estate pursuant to <br />Chapter 14.5 of the Municipal Code of the City of South Bend. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works <br />of the City of South Bend, Indiana: <br />1. That the parcels of real estate owned by <br />the city contained in the following list <br />are not necessary to the public use and <br />are not set aside by state or city law <br />for public purposes: <br />
