MW <br />REGULAR MEETING JANUARY 2, 1979 <br />VACATION RESOLUTION NO. 3467 CONFIRMED <br />This being the date set, hearing was held on Vacation Resolution <br />No. 3467 for the vacation of the first alley south of Monroe Street, <br />running east from Columbia Street approximately one -half block <br />towards Fellows Street, then south to the second alley south of <br />Monroe Street running east and west between Columbia Street and <br />Fellows Street. The Clerk tendered proofs of publication of notice <br />in the South Bend Tribune and the Tri- County News which were found <br />to be sufficient. Lloyd Allen, Attorney, was present on behalf <br />of George Ross, who is in the process of purchasing a tract of land <br />abutting the alleys for the purpose of erecting a new business <br />building in the area. It is for this purpose that the vacation is <br />being requested. Mr. Allen said adjacent property owners have been <br />contacted and he knows of no objection to the vacation. Marvin Walz, <br />Evangelical Church Building Corporation, said the church had not <br />been contacted and they do own property in the area. He asked for <br />clarification on the reason for the vacation and said the church <br />property is for sale. Mr. Allen said the vacation is being requested <br />for the erection of a new building for Tire Service, Inc. A map of <br />the area was displayed and Mr. Walz was advised of the lots affected <br />by the alley closing. It was indicated that there are no plans to <br />close the alley behind the church property and that the vacated <br />property will be divided among the abutting property owners. Mr. Walz <br />said he was just interested iniclarification of the plans and had <br />no objection at this time. Mr. Mullen asked if the property was <br />properly zoned for the planned operation and Mr. Allen replied that <br />it was properly zoned. Upon motion made by Mr. McMahon, seconded <br />by Mr. Brunner and carried, the Vacation Resolution was confirmed <br />and the Board directed that an Assessment Roll showing benefits and <br />damages to affected properties be prepared. <br />ASSESSMENT ROLL APPROVED - VACATION RESOLUTION NO. 3465, 1978 <br />PROCEEDINGS CLOSED <br />This being the date set, hearing was held on the Assessment Roll <br />with respect to Vacation Resolution No. 3465, 1978 for the <br />vacation of the first alley south of Mishawaka Avenue from 34th Street <br />to the first north -south alley. The Clerk tendered proofs of <br />publication of notice in the South Bend Tribune and the Tri- County <br />News which were found to be sufficient. There was no one present <br />to speak on the Assessment Roll and no written remonstrances were <br />filed with the Board. Upon motion made by Mr. McMahon, seconded <br />by Mr. Mullen and carried, the Assessment Roll listing $0.00 net <br />benefits and $0.00 net damages was approved and said resolution is <br />in all things ratified and confirmed and said proceedings closed. <br />SALE OF PARKING METERS AND SPARE PARTS;APPROVED <br />Joseph Paszli, Manager of the Municipal Parking Facilities, submitted <br />to the Board a recommendation that Bicentennial Parking Meters be <br />sold on an as--is basis for $35.00 each. It was noted that the <br />meters were purchased for $9.0.00 each in.1975 and that there are <br />forty meters for sale. Mr. Paszli advised the Board that he has <br />received approximately fifty requests to purchase the meters. The <br />Board directed that the meters be sold by drawing lots from the names <br />received. Mr. Paszli also requested authorization to negotiate the <br />prase of spare meter parts with prospective purchasers. Upon motion <br />made by Mr. McMahon, seconded by Mr, Mullen and carried, the Board <br />authorized Mr. Paszli to sell the Bicentennial Meters as /is for <br />$35.00 each and to negotiate the price of spare parts with buyers.. <br />
