Em <br />REGULAR MEETING <br />A regular meeting of the Board <br />9:30 a.m. on Monday, September <br />McMahon, with Mr. McMahon, Mr. <br />Deputy City Attorney Terry A. <br />y <br />SEPTEMBER 11, 1978 <br />of Public Works was convened at <br />11, 1978 by President Patrick M. <br />Brunner and Mr. Mullen present. <br />Crone was also present. <br />MINUTES OF PREVIOUS MEETING APPROVED <br />Mr. Mullen reported that the minutes of the regular meeting of <br />September 5 had been reviewed and he made a motion that they be <br />a �rove.d as submitted. Mr. McMahon seconded the motion and it <br />carried. <br />ASIPFFS. ".ENT ROLL APPROVED VACATION RESOLUTION NO. 3461 <br />This being the date set, hearing was held on the Assessment Roll <br />with respect to Vacation Resolution No. 3461 for the vacation of <br />the east -west alley between 15''0° an &' 15`0` `South Miami, from Miami' <br />Street west to the lst north -south alley for a distance of 137 <br />feet. The Clerk tendered proofs of publication of notice in <br />the South Bend Tribune and the Tri- County News which were found <br />to be sufficient. Mr. McMahon noted that this was the public <br />hearing on the Assessment Roll. There was no one present who <br />wished to speak on the matter and no written remonstrances were <br />filed with the Board. Upon motion made by Mr. McMahon, seconded <br />by Mr. Mullen and carried, the Assessment Roll showing $0.00 net <br />damages and $0.00 net benefits was approved and said resolution <br />is in all things ratified and confirmed and said proceedings closed. <br />EDGEWATER PLACE NEIGHBORHOOD ASSOCIATION - REQUEST SEWERS CLEANED <br />The Board received a letter and petition signed by residents of <br />the area of Edgewater Place neighborhood. Mr. Phil Beach, 815 <br />Arch Avenue, was present. He said he has spoken to city agencies <br />involved and they have told him the sewers in that area have been <br />cleaned recently. Mr. Beach said he has lived there for over <br />three years and he has never seen them cleaned. He requested <br />the Board take proper action to have this matter taken care of. <br />Mr. McMahon stated that sewers are routinely cleaned about every <br />three years. He said the matter will be taken care of. Mr. <br />McMahon moved that the request and petition be referred to <br />John Stancati, Director of Utilities, for inspection of the sewers. <br />Mr. Brunner seconded the motion and it carried. <br />AGREEMENTS WITH INDIANA STATE HIGHWAY COMMISSION - RE: SAMPLE <br />STREET RAILROAD CROSSING IMPROVEMENTS <br />Mr. McMahon stated that two contracts were submitted by the State <br />in response to a request from the city to have certain railraod <br />crossings improved. The two the State has agreed to repair are <br />`on Sample Street in front of the Municipal Services Facility and <br />at Sample and Lafayette. The City is to pay 10% of the project <br />cost. Upon motion made by Mr. McMahon, seconded by Mr. Brunner <br />and carried, the agreements were approved, subject to Legal Department <br />concurrence. <br />TAXI LICENSE APPLICATION DENIED --ROBERT EDWARD RICHARD <br />Peter H. Mullen, City Controller, submitted to the Board his <br />recommendation, in concurrence with the Police Department, that <br />the taxi driver's license application of Robert Edward Richard <br />should be denied. Upon motion made by Mr. McMahon, seconded by <br />Mr. Brunner and carried, with Mr. Mullen abstaining,: the Board <br />approved the recommendation to deny the license. The applicant <br />will be notified that he can request a hearing on the denial <br />before the Board of Public Works. <br />I <br />LJ <br />
