ajL 6 <br />REGULAR MEETING <br />JANUARY 21, 1-980 <br />A regular meeting of the Board of Public Works was convened at <br />9:30 a.m., on Monday, January 21, 1980, by President Patrick M. <br />McMahon, with Mr. McMahon, Mr. Richard L. Hill and Mr. Joseph E. <br />Kernan present. Deputy City Attorney Terry A. Crone was also present. <br />AGENDA ITEM ADDED <br />Mr. McMahon noted receipt of an Addendum to Lease with R.E.A.L. <br />Services, and he made a motion that the item be added to the agenda <br />at this time. Mr. Kernan seconded the motion and it carried. <br />MINUTES OF PREVIOUS MEETING APPROVED <br />Mr. McMahon reported that the minutes of the regular meeting held <br />on January 14, 1980, had been reviewed, and Mr. Kernan made a <br />motion that the minutes be approved as submitted. Mr. McMahon <br />seconded the motion and it carried. <br />PUBLIC HEARING - VACATION RESOLUTION NO. 3485 <br />This was the date set for holding a public hearing on Vacation Resolu- <br />tion No. 3485, for the vacation of a 14' north -south alley between <br />Main and Lafayette, starting at Navarre; thence south for a distance <br />of 99'; and the vacation of a 14' east -west alley between Navarre <br />and Marion, starting at Lafayette; thence east for a distance of <br />165' to the intersection of the north -south alley (both being in <br />the Original Plat of South Bend). The Clerk tendered proofs of <br />publication of notice in the South Bend Tribune and the Tri- <br />County News which were found to be sufficient. It was noted that <br />a notice had been sent to all public and private utilities and <br />property owners in the vicinity of the proposed vacation. Mr. <br />Joseph Forte, attorney for the South Bend Medical Foundation, with <br />offices at 214 West Washington Street, made the presentation for <br />the vacation. He introduced Mr. Joseph Mathews of Mathews-Puruckel.- <br />Anella Architects, and Mr. Raymond Markey and Mr. Robert Annis <br />representing the Foundation. Mr. Mathews presented to the Board <br />drawings and maps showing the proposed vacation in relation to the <br />surrounding properties and the Foundation. He indicated that the <br />new five -story facility would have a new entrance on Lafayette <br />Boulevard and exits have been increased and the City of South Bend <br />has been granted a 14' easement. He explained that there was ample <br />space and no obstruction for remaining residential occupancy. It <br />was his opinion that the traffic problem on Navarre would be relieved <br />somewhat if the proposed vacation was approved. Mr. McMahon asked <br />how much parking the Foundation had, and Mr. McMahon indicated that <br />there were 128 spaces. Mr. Hill asked if there was a building on <br />the corner of Lafayette and Navarre, and Mr. Mathews indicated that: <br />the building would be removed. Mr. Markey stated that the medical <br />technology center was housed there. Mr. McMahon asked about the <br />property owned by the Foundation, and Mr. Markey indicated that all <br />the properties on Lafayette were owned by the Foundation except <br />property on the corner and Mr. Brennan's property on Marion Street. <br />Mr. Patrick Brennan, 215 West Marion Street, presented to the Board <br />a drawing of the area showing the residential properties. He talked <br />about the one -way street system in the area, stating that the alleys <br />were needed by the property owners in view of the system. He stated <br />that he was opposed to the vacation of the two alleys by the Medical <br />Foundation. Ms. Margaret Martin, 525 North Main, indicated that <br />she lived next door to the Medical Lab, and she talked about the <br />use of the alleys in question. She wondered about trash pick -up <br />and oil deliveries to her home should the alleys be vacated. She <br />stressed her opposition to the proposed vacation. Mr. McMahon <br />informed the Board members that, when the resolution was originally <br />submitted for the vacation of the alleys, the Board indicated that <br />a portion of the vacation would be considered if there was an <br />easement granted to the city. Ms. Annebelle Brehmer, 609 North <br />Lafayette Boulevard, indicated that the Circle of Mercy Day Care <br />
