114 <br />REGULAR MEETING <br />JULY 9, 1979 <br />A regular meeting of the Board of Public Works was convened at <br />9:30 a.m, on Monday, July 9, 1979 by Chairman Pro -Tem Peter H. <br />Mullen, with Mr. Mullen and Mr, Brunner present and Mr. McMahon <br />absent. Deputy City Attorney Terry A. Crone was also present. <br />AGENDA ITEMS ADDED <br />Mr. Mullen noted receipt of a request from the Potpourri and a <br />memorandum from the Board of Public Safety regarding police radios <br />and he made a motion that the items be added to the agenda. Mr. <br />Brunner seconded the motion and it carried. <br />REVIEW OF MINUTES OF PREVIOUS MEETING <br />Mr. Brunner reported that the minutes of the July 2 meeting had <br />been reviewed and he made a motion that the minutes be accepted <br />as submitted. Mr. Mullen seconded the motion and it carried. <br />OPENING OF BIDS - SCARIFICATION AND REPAVING OF VARIOUS STREETS <br />This was the date set for receiving bids for the curb, sidewalk, <br />scarification and repaving of Miami Street, from Altgeld to Indiana, <br />and the scarification and repaving,of Rockne Drive, from Ironwood to <br />Twyckenham and Ford Street, from Olive Street to the railroad. The <br />Clerk tendered proofs of- publication of-notice in the South Bend <br />Tribune and the Tri- County News which were found to be sufficient. <br />The following bids were opened and publicly read: <br />Arco Engineering Construction Company <br />Mishawaka, Indiana <br />Bid - $348,250.40 <br />Rieth -Riley Construction Company <br />South Bend, Indiana <br />Bid - $315,641.50 <br />Bid was signed by William <br />Zirkle, non - collusion <br />affidavit was in order and <br />a 10% bid bond was submitted. <br />Bid was signed by Richard <br />D. Ruhlman; non - collusion... <br />affidavit was in order and <br />a 5% bid bond was submitted. <br />Walsh & Kelly, Inc. Mr, Crone advised the Board that there was no <br />amount filled in on the bid bond submitted by Walsh and Kelly with <br />their bid. He noted this was not a fatal defect and the bid could <br />be considered if the amount was filled in. Upon motion made by Mr. <br />Mullen, seconded by Mr. Brunner and carried, the Board agreed to <br />allow Walsh and Kelly until the close of business today to fill in <br />the amount on the bid bond, at which time the bid could be considered. <br />Upon motion made by Mr, Mullen, seconded by Mr. Brunner and carried, <br />the bids were referred to the Bureau of Engineering and the Director <br />of Utilities for review and recommendation. <br />A representative from Walsh and Kelly appeared and filled in the. <br />amount on the bid bond. The bid was then publicly read as follows: <br />Walsh & Kelly, Inc. <br />South Bend, Indiana <br />Bid was signed by Patrick <br />Cahill, non - collusion affidavit <br />was in order and a 5% bid bond <br />was submitted. <br />Bid - $296,852.12 <br />Upon motion made by Mr. Mullen, seconded by Mr. Brunner and carried, <br />the bid was referred to the Division of Engineering and the Director <br />of Utilities for review and recommendation. <br />
