114 REGULAR MEETING JULY 9, 1979 A regular meeting of the Board of Public Works was convened at 9:30 a.m, on Monday, July 9, 1979 by Chairman Pro -Tem Peter H. Mullen, with Mr. Mullen and Mr, Brunner present and Mr. McMahon absent. Deputy City Attorney Terry A. Crone was also present. AGENDA ITEMS ADDED Mr. Mullen noted receipt of a request from the Potpourri and a memorandum from the Board of Public Safety regarding police radios and he made a motion that the items be added to the agenda. Mr. Brunner seconded the motion and it carried. REVIEW OF MINUTES OF PREVIOUS MEETING Mr. Brunner reported that the minutes of the July 2 meeting had been reviewed and he made a motion that the minutes be accepted as submitted. Mr. Mullen seconded the motion and it carried. OPENING OF BIDS - SCARIFICATION AND REPAVING OF VARIOUS STREETS This was the date set for receiving bids for the curb, sidewalk, scarification and repaving of Miami Street, from Altgeld to Indiana, and the scarification and repaving,of Rockne Drive, from Ironwood to Twyckenham and Ford Street, from Olive Street to the railroad. The Clerk tendered proofs of- publication of-notice in the South Bend Tribune and the Tri- County News which were found to be sufficient. The following bids were opened and publicly read: Arco Engineering Construction Company Mishawaka, Indiana Bid - $348,250.40 Rieth -Riley Construction Company South Bend, Indiana Bid - $315,641.50 Bid was signed by William Zirkle, non - collusion affidavit was in order and a 10% bid bond was submitted. Bid was signed by Richard D. Ruhlman; non - collusion... affidavit was in order and a 5% bid bond was submitted. Walsh & Kelly, Inc. Mr, Crone advised the Board that there was no amount filled in on the bid bond submitted by Walsh and Kelly with their bid. He noted this was not a fatal defect and the bid could be considered if the amount was filled in. Upon motion made by Mr. Mullen, seconded by Mr. Brunner and carried, the Board agreed to allow Walsh and Kelly until the close of business today to fill in the amount on the bid bond, at which time the bid could be considered. Upon motion made by Mr, Mullen, seconded by Mr. Brunner and carried, the bids were referred to the Bureau of Engineering and the Director of Utilities for review and recommendation. A representative from Walsh and Kelly appeared and filled in the. amount on the bid bond. The bid was then publicly read as follows: Walsh & Kelly, Inc. South Bend, Indiana Bid was signed by Patrick Cahill, non - collusion affidavit was in order and a 5% bid bond was submitted. Bid - $296,852.12 Upon motion made by Mr. Mullen, seconded by Mr. Brunner and carried, the bid was referred to the Division of Engineering and the Director of Utilities for review and recommendation.
