i� <br />REGULAR MEETING JUNE 11, 1979 <br />REQUEST TO PAINT HOUSE NUMBERS ON CURBS DENIED <br />The Board received a request from the Bethel Brethren Church <br />to allow members of a youth group to paint house numbers on <br />curbs in South Bend for a donation from the property owner. <br />Mr. Brunner noted that the liability exposure to the City in <br />such a program would be very great. Mr. McMahon pointed out <br />that a similar request from the Youth Services Bureau, a city <br />agency, to conduct this program last year as part of the Rent - <br />A -Teen Program was denied because of the possibility of liability <br />to the City. Upon motion made by Mr. McMahon, seconded by Mr. <br />Brunner and carried, the Board denied the request based on the <br />opinion of the City Attorney's Office that it would expose the <br />City to possible liability action. <br />REQUEST FOR EASEMENT OVER INDIANA AVENUE FILED <br />The Board received a request from ITT Terryphone to run a wire <br />across Indiana Avenue at the Ridge Company location, 1353 S. Main <br />Street, to install a communications system. Deputy City Attorney <br />James Masters reviewed the request and submitted a written <br />opinion that the Board has the authority to grant such an <br />easement. Upon motion made by Mr. McMahon, seconded by Mr. Brunner <br />and carried, the request was referred to the Bureau of Traffic <br />and Lighting and the Police Department for review and recommendation. <br />ADOPTION OF IMPROVEMENT RESOLUTION NO. 3475, 1979 <br />The Bureau of Design and Administration submitted to the Board <br />preliminary plans, an engineer's estimate, preliminary assessment <br />roll and an improvement resolution for the construction of <br />sanitary sewers on Hawbaker Street. The project was initiated <br />by a petition of pro erty owners under Barrett Law. The estimate <br />is in the amount of $47,483.42, of which the City will pay fifty <br />per cent. Upon motion made by Mr, McMahon, seconded by Mr. Brunner <br />and carried, the Board filed the plans, estimate and preliminary <br />assessment roll and adopted the following resolution: <br />IMPROVEMENT RESOLUTION NO. 3475 <br />BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS of the City of South <br />Bend, Indiana, that it is deemed necessary to improve <br />Hawbaker Street.by the construction of a local sewer, intended <br />and adapted only for local use by the property owners whose <br />property abuts thereon and not intended or adapted for receiving <br />sewage from collateral drains. Said sewer to be eight inches <br />in diameter, and said sewer, with all its appurtenances, to be <br />constructed in accordance with the profiles, drawings, plans, <br />general details and specifications of such improvement approved <br />and adopted herewith and placed on file in the office of the Board <br />of Public Works of said City, and such improvement is now ordered. <br />The total cost of said improvement, including all incidental costs, <br />such as advertising, abstracting, inspection and engineering, shall <br />be assessed upon the real estate abutting on said street in <br />accordance with applicable statutes. The said improvement is to <br />be financed and paid for as provided in Chapter 40, of the Acts <br />of 1953 as amended (1971 I.C. 18 -6 -3). Assessments, if deferred, <br />are to be paid in five equal installments, with interest at the <br />rate of six (6) per cent per annum. <br />
