UJ Q 13 REGULAR MEETING APRIL 2, 1979 ADOPTION OF RESOLUTION NO. 9, ACQUISITION OF ODD FELLOWS BUILDING Robert 9,r—Parker, Deputy City Attorney, submitted to the Board a proposed resolution for the acquisition of the Odd Fellows Building along with a memo advising that the Board needs to establish the just compensation for the building by its appraisal at $295,000. The deadline for exercising the option to purchase is April 2 and notice has been given to the I.O.O.F, of the exercise. The resolution also provides for approval of the exercise. Carl Ellison, Director of the Department of Redevelopment, was present and noted that the resolution fulfills requirements of the Redevelopment Statute. Upon motion made by Mr. McMahon, seconded by Mr. Brunner and carried, the following Resolution was adopted: RESOLUTION NO. 9, 1979 A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, RELATING TO THE ACQUISITION OF THE ODD FELLOWS BUILDING WHEREAS, the City of South Bend acting through its Board of Public Works desires to acquire the Odd Fellows Building in South Bend, Indiana; WHEREAS, appraisal has been made of said property at the request of the city and the amount of such appraisal is $295,000.00; WHEREAS, the City has entered into an option to purchase the Odd Fellows.Building for $288,000, which option is exercisable on or before April 2, 1979. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South Bend, Indiana: SECTION 1. That just compensation for the real estate and improvements th'er:eon.-. located in the City of South Bend, St. Joseph County, State of Indiana, commonly known as the "Odd Fellows Building" and more particularly described as: "A part of Lots Numbered 35 and 36 shown on the Original Plat of the Town, now City of South Bend, described as follows, viz: Beginning at the Northwest corner of said Lot No. 36; thence East along the North line of said Lot No. 36, a distance of 66 feet 10 inches; thence South a distance of 132 feet to the south line of said Lot No. 35; thence West to the South West corner of said Lot No. 35, a distance of 66 feet 10 inches to the South West corner of said Lot No. 35; thence north along the West line of said Lots Nos. 35 and 36, a distance of 132 feet to the place of beginning. Subject to a private alley 10 feet in width, North and South, taken off of and from the entire width of the South Side of said tract ". is $295,000.00. SECTION II. The Board approves.the exercise of the option to purchase said property for the sum of $288,000.00 and directs that all other proper and necessary actions be taken to complete this purchase.
