UJ <br />Q <br />13 <br />REGULAR MEETING APRIL 2, 1979 <br />ADOPTION OF RESOLUTION NO. 9, ACQUISITION OF ODD FELLOWS BUILDING <br />Robert 9,r—Parker, Deputy City Attorney, submitted to the Board a <br />proposed resolution for the acquisition of the Odd Fellows Building <br />along with a memo advising that the Board needs to establish <br />the just compensation for the building by its appraisal at <br />$295,000. The deadline for exercising the option to purchase is <br />April 2 and notice has been given to the I.O.O.F, of the exercise. <br />The resolution also provides for approval of the exercise. Carl <br />Ellison, Director of the Department of Redevelopment, was present <br />and noted that the resolution fulfills requirements of the Redevelopment <br />Statute. Upon motion made by Mr. McMahon, seconded by Mr. Brunner <br />and carried, the following Resolution was adopted: <br />RESOLUTION NO. 9, 1979 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA, RELATING <br />TO THE ACQUISITION OF THE ODD FELLOWS BUILDING <br />WHEREAS, the City of South Bend acting through its Board of Public <br />Works desires to acquire the Odd Fellows Building in South Bend, <br />Indiana; <br />WHEREAS, appraisal has been made of said property at the request <br />of the city and the amount of such appraisal is $295,000.00; <br />WHEREAS, the City has entered into an option to purchase the Odd <br />Fellows.Building for $288,000, which option is exercisable on or <br />before April 2, 1979. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the <br />City of South Bend, Indiana: <br />SECTION 1. That just compensation for the real estate and improvements <br />th'er:eon.-. located in the City of South Bend, St. Joseph County, State <br />of Indiana, commonly known as the "Odd Fellows Building" and more <br />particularly described as: <br />"A part of Lots Numbered 35 and 36 shown on the <br />Original Plat of the Town, now City of South Bend, <br />described as follows, viz: Beginning at the Northwest <br />corner of said Lot No. 36; thence East along the North <br />line of said Lot No. 36, a distance of 66 feet 10 <br />inches; thence South a distance of 132 feet to the south <br />line of said Lot No. 35; thence West to the South West <br />corner of said Lot No. 35, a distance of 66 feet 10 <br />inches to the South West corner of said Lot No. 35; thence <br />north along the West line of said Lots Nos. 35 and 36, a distance <br />of 132 feet to the place of beginning. <br />Subject to a private alley 10 feet in width, North and <br />South, taken off of and from the entire width of the <br />South Side of said tract ". <br />is $295,000.00. <br />SECTION II.
