It was <br />pointed out that this area is zoned "Light Industrial ", in which category <br />this type of activity will fit. His move to this location from the corner <br />of Fox and Michigan Streets, is due to an order for removal of this hazar- <br />dous equipment, issued by the Fire Inspector, from their Michigan'Street <br />location. The Board directed that a 6 -foot industrial fence be erected <br />completely around the lot, as requested by Fire Chief, Richard J. Duck. <br />This was agreed to by Mr. Benjamin, and it was also understood and agreed <br />that any trailers parked in this enclosed area are to be empty. After <br />the regulations of the Fire Chief have been complied with, the Board agreed <br />to issue a tentative permit to use this area for the transport terminal <br />facilities and purposes meeting the present needs of his business. <br />The Board next took up the matter of the restoration to Glenn A. Hess <br />of his position as a police and fire alarm operator in accord with the <br />decree of St. JOseeph Superior Court No.2, dated November 13, 1952• <br />Mr. Glenn A. Hess and his attorney, Jos. <br />The chairman of the Board, Irving A. Hurwich, stattedpthat guponnAprilsl7th <br />1953, the court entered a further decree finding Mr. Hess to sicall <br />fit to perform the duties of a police and fire alarm operatorbandhreaffirm- <br />ed the decree previously entered on November 13, 1952. <br />Mr. Glenn A. Hess, accompanied by his attorney, then presented himself <br />for assignment to duty in the Fire Alarm and Signal Station of the City <br />of South Bend. Mr. Hess and his attorney were advised that it would be <br />necessary, under the Acts of 1937, to take the physical examination and <br />meet the requirements for admission into the Firemants Pension Fund, <br />Attorney Hemphling stated that this constituted a separate matter, but <br />that Mr. Hess would submit to the examination without waiving any legal <br />rights pertaining to his eligibility for admission into the Pension Fund. <br />Thereupon, the Board directed the Fire Chief, Richard J. Duck, to assign <br />Mr. Hess to duty, and the question of any rights under <br />was left to be determined as a separate issue. the Pension Fund <br />
