SPECIAL MEETIN G JULY 7, 2010 55 <br />South Bend Fire Department Duty Manual and South Bend Fire Department Standard Operating <br />Procedure 231.002. This was conduct unbecoming an Officer of the South Bend Fire Department <br />and a violation of I.C. 36- 8- 34(b)(2)(A),(B),(C) and (H). <br />CHARGE V <br />On June 14, 2010 at approximately 7:02 p.m. Engine 3 was dispatched to 107 N. St. Louis <br />Boulevard, South Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving <br />company on the scene, but when his tour of duty day was completed he did not enter the necessary <br />Fire Incident Report for the run. This failure to timely enter a report violated Rules 202.05 and <br />204.07 of the South Bend Fire Department Duty Manual and South Bend Fire Department Standard <br />Operating Procedure 231.002. This was conduct unbecoming an Officer of the South Bend Fire <br />Department and a violation of I.C. 36- 8- 34(b)(2)(A),(B),(C) and (H). <br />CHARGE VI <br />On June 14, 2010 at approximately 7:56 p.m. Engine 3 was dispatched to 3454 E. Douglas Road, <br />South Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving company on <br />the scene, but when his tour of duty day was completed he did not enter the necessary Fire Incident <br />Report for the run. This failure to timely enter a report violated Rules 202.05 and 204.07 of the <br />South Bend Fire Department Duty Manual and South Bend Fire Department Standard Operating <br />Procedure 231.002. This was conduct unbecoming an Officer of the South Bend Fire Department <br />and a violation of I.C. 36- 8- 34(b)(2)(A),(B),(C) and (H). <br />CHARGE VII <br />On June 14, 2010, at approximately 8:55 p.m. Engine 3 was dispatched to 1617 E. McKinley <br />Avenue, South Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving <br />company on the scene, but when his tour of duty day was completed he did not enter the necessary <br />Fire Incident Report for the run. This failure to timely enter a report violated Rules 202.05 and <br />204.07 of the South Bend Fire Department Duty Manual and South Bend Fire Department Standard <br />Operating Procedure 231.002. This was conduct unbecoming an Officer of the South Bend Fire <br />Department and a violation of I.C. 36- 8- 3- 4(b)(2)(A),(B),(C) and (H). <br />CHARGE VIII <br />On June 14, 2010 at approximately 11:06 p.m. Engine 3 was dispatched to 956 N. Patty Lane, South <br />Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving company on the <br />scene, but when his tour of duty day was completed he did not enter the necessary Fire Incident <br />Report for the run. This failure to timely enter a report violated Rules 202.05 and 204.07 of the <br />South Bend Fire Department Duty Manual and South Bend Fire Department Standard Operating <br />Procedure 231.002. This was conduct unbecoming an Officer of the South Bend Fire Department <br />and a violation of I.C. 36- 8- 34(b)(2)(A),(B),(C) and (H). <br />CHARGEIX <br />On June 15, 2010 at approximately 12:54 a.m. Engine 3 was dispatched to 920 N. Patty Lane, South <br />Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving company on the <br />scene, but when his tour of duty day was completed he did not enter the necessary Fire Incident <br />Report for the run. This failure to timely enter a report violated Rules 202.05 and 204.07 of the <br />South Bend Fire Department Duty Manual and South Bend Fire Department Standard Operating <br />Procedure 231.002. This was conduct unbecoming an Officer of the South Bend Fire Department and <br />a violation of I.C. 36- 8- 34(b)(2)(A),(B),(C) and (H). <br />RECOMMENDATION <br />Due to Captain David Schackow not following a direct order in compliance with the Duty annual <br />Section 300.03 Rules of Conduct, Fire Chief Howard Buchanon recommended that he be receive five <br />(5) eight -hour day's (40 hours) suspension without pay equaling $697.20. The Chief also <br />recommended the demotion to the rank of Engineer because Captain Schackow has not tried to <br />rectify the situation. <br />President Dempsey stated the Board would accept the charges for filing and instructed the Clerk to <br />prepare a letter to serve the Charges on Captain David Schackow. Upon a motion made by Mr. <br />BonDurant, seconded by Mr. Cottrell and carried, the charges were accepted and filed and Chief <br />Buchanan's recommendation was approved. <br />POLICE DEPARTMENT <br />
