<br />The Board of Public Safety met in a Special Meeting at 8:18 a.m. on Monday, July 7, 2010, with
<br />Board President Juanita Demsey and Board Members Patrick Cottrell and Bruce BonDurant present.
<br />Board Members Laura Vasquez and Eddie Miller were absent. Board Attorney Thomas Bodnar was
<br />also present.
<br />The meeting was held in the Board of Public Works Meeting Room, 13`h Floor County City
<br />Building, South Bend, Indiana.
<br />FILING OF CHARGES - CHARGE — 2010 -03— DAVID SCHACKOW
<br />FACTUAL ALLEGATIONS
<br />In May and June 2010 David Schackow was a Captain in the South Bend Fire Department and was
<br />assigned as Captain of Engine 3 at Station 3 of the South Bend Fire Department. As part of his
<br />duties he was to complete by the end of his tour of duty each day Fire Incident Reports concerning
<br />every run in which the engine company was the first to arrive at the scene and enter them into the
<br />computer (handwritten reports when the computer reporting system is down). From May 9, 2010
<br />through June 15, 2010 he failed to complete and enter any reports on the computer (or by hand if the
<br />computer was down) for each of the following runs made by Engine 3:

<br />On May 9, 2010 at approximately 12:51 p.m. Engine 3 was dispatched to 1206 N. St. Louis
<br />Boulevard, South Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving
<br />company on the scene, but when his tour of duty day was completed he did not enter the necessary
<br />Fire Incident Report for the run. This failure to timely enter a report violated Rules 202.05 and
<br />204.07 of the South Bend Fire Department Duty Manual and South Bend Fire Department Standard
<br />Operating Procedure 231.002. This was conduct unbecoming an Officer of the South Bend Fire
<br />Department and a violation of I.C. 36- 8- 3- 4(b)(2)(A),(B),(C) and (H).

<br />On May 11, 2010 at approximately 12:19 p.m. Engine 3 was dispatched to 2530 E. Edison
<br />Road, South Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving
<br />company on the scene, but when his tour of duty day was completed he did not enter the necessary
<br />Fire Incident Report for the run. This failure to timely enter a report violated Rules 202.05 and
<br />204.07 of the South Bend Fire Department Duty Manual and South Bend Fire Department Standard
<br />Operating Procedure 231.002. This was conduct unbecoming an Officer of the South Bend Fire

<br />Avenue, South Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving
<br />company on the scene, but when his tour of duty day was completed he did not enter the necessary
<br />Fire Incident Report for the run. This failure to timely enter a report violated Rules 202.05 and
<br />204.07 of the South Bend Fire Department Duty Manual and South Bend Fire Department Standard

<br />South Bend, Indiana. David Schackow was the Captain on Engine 3, the first arriving company on
<br />the scene, but when his tour of duty day was completed he did not enter the necessary Fire Incident
<br />Report for the run. This failure to timely enter a report violated Rules 202.05 and 204.07 of the
