<br />SECTION I. That for all sworn police officers who are assigned to work as their regular
<br />schedule, 5 on and 2 off, Monday through Friday, the following holidays shall apply:
<br />New Year's Day

<br />Labor Day
<br />Veteran's Day
<br />Thanksgiving Day

<br />SECTION II. That for all sworn police officers who are assigned to work as their regular
<br />work schedule, 6 days on and 3 days off, there shall be no paid holidays. The following dates are
<br />designated as Critical Duty Days:

<br />For purposes of the Critical Duty Day stipend, the Critical Duty Day shall start at 6:00 a.m.,
<br />and last 24 hours.
<br />SECTION III. Officers assigned to the South Bend Community School Corporation shall,
<br />while so assigned, follow the holiday schedule set by the South Bend Community School
<br />Corporation for its clerical Employees. Officers so assigned shall be eligible for Critical Duty Day
<br />pay only if assigned to the Uniform Division and otherwise eligible.
<br />SECTION IV. To be eligible for a Critical Duty Day stipend, the Officer must either work
<br />the entire shift or have suffered an injury on the job which prevents working the entire shift. Any
<br />Officer who works recall on a Critical Duty Day, whether voluntary or required, shall receive in
<br />addition to overtime pay the normal Critical Duty Day stipend.

<br />APPROVAL OF LEAVE OF ABSENCE -PATROLMAN BILLY PELLETIER
<br />Chief Thomas Fautz stated Patrolman Billy Pelletier has requested an unpaid leave of absence,
<br />starting December 15, 2005, with continued health benefits until his disability pension is determined.
<br />Chief Fautz stated that pursuant to. I.C. 36-8-8-12.3(d)(a), there is no suitable or available work in
<br />the South Bend Police Department for which Patrolman Billy Pelletier is or may be capable of
<br />becoming qualified, considering reasonable accommodation to the extent required by the Americans
<br />with Disabilities Act. Also noted was the fact that Officer Pelletier was shot in the line of duty on
<br />April 25, 2005. Upon a motion made by Mr. Alford, seconded by Ms. Dempsey and carried, the
<br />request was approved.
