`,~ <br />~~ <br />C~ ZONING AND ANNEXATION COMMITTEE MAY 24, 2010 <br />Al "Buddy" Kirsits, Chairperson, Zoning and Annexation Committee called the meeting <br />to order at 4:13 p.m. <br />Committee Members Present: Tom LaFountain, Oliver Davis, David Varner <br />Other Councilmember's Present: Derek Dieter, Ann Puzzello, Tim Rouse, Henry Davis, <br />Karen White <br />Other's Present: John Byorni, Mayor Luecke, Gary Gilot, Barbara Huber, Dan Herbster, <br />Jeff Parrott, Isaac Hunt, Charles Watkins, Billy Gene Easton, Tom Bush, Rita Kopala, <br />Chuck Leone <br />Agenda: Preliminary Discussion PUD -Byorni <br />*John Byorni presents 3rd revision: <br />John Byorni, Executive Director of the Area Plan Commission, was given the opportunity <br />by Chairperson Kirsits to present the latest version of the APC's proposed changes for <br />Planned Unit Developments. More specifically the changes would revise criteria for <br />changes and time limits to obtain approval. The main sticking point in recent Council <br />proposal reviews seems to be in whether a developer would be granted an extension of 2 <br />years from-the current three for changes to the preliminary plan. The Council's concerns <br />are about maintaining timely progression of a project as well as the type of changes. <br />Councilmember Rouse said he recognized the effect of the weak economy has had on <br />proposed projects. However he expressed concern over the deleterious impact a delayed <br />or suspended projects can become safety hazards, altogether having a negative effect on <br />nearby properties. Byorni suggested that it would be difficult to hold a developer to a <br />specific timetable. However, he said the Council would keep control over any changes to <br />the preliminary plan. <br />Councilmember Rouse along with Councilmember White stressed the importance of <br />Council involvement in the crafting process. They suggested a special meeting with all <br />affected parties at the table to craft provisions which would not discourage developers; <br />yet would require them to be respectful and responsible. <br />Along those same lines Chairperson Kirsits cautioned that if increased flexibility is <br />allowed developers will have an increased responsibility to the city.
