a l;~ •~ <br />REGULAR MEETING <br />POLICE DEPARTMENT <br />FEBRUARY 16.2005 <br />CHARGE OS-01 -BRIAN KENDALL <br />Upon a motion made by Mr. Carr, seconded by Mr. Taylor and carried, Charges against Brian <br />Kendall were accepted by the Board of Public Safety as follows: <br />COUNTI <br />On January 21, 2005 Sergeant Brian Kendall was found guilty of operating a vehicle with a blood <br />alcohol content 0.08 in violation of IC 35-50-3-4, a Class D misdemeanor in the Morgan Superior <br />Court, Cause Number 55-DO1-0412-CM-352. Such conduct violates IC 36-8-3-4(b)(1). <br />COUNT II <br />On December 8, 2004 Sergeant Brian Kendall, a member of the South Bend Police Department, <br />while off duty on Pleodis Drive, Mooresville, Indiana operated a motor vehicle with a blood alcohol <br />content of 0.08. Said conduct violates IC 35-50-3-4, Rules 302.00(A)(1), (2), and (3) of the South <br />Bend Police Department Duty manual and IC 36-8-3-4(b)(2)(B) and (H). <br />Chief Fautz recommended that~he be suspended from duty without pay for twenty-one (1) calendar <br />days beginning June 10, 2005, and also a two (2) year loss of his take-home vehicle which will be <br />reduced to one (1) year after successful completion of an Alcohol Program. This suspension will <br />begin immediately. <br />Mr. Bodnar submitted the Finding of Fact in Charge OS-O1. The Board instructed the Clerk to <br />prepare the appropriate letter and deliver the same to Mr. Brian Kendall. <br />Mr. Bodnar gave said letterto Sgt. Kendall during this meeting, and Sgt. Kendall returned it with <br />signature, thereby accepting the:'disciplinary action. Mr. Bodnar asked the Board to consider the <br />Finding of Fact, in orderito{dispose `ol=`Charge 05-01. Upon a motion made by Mr. Taylor, seconded <br />by Mr. Carr and carried, the 1~inding of Fact was accepted and the matter disposed. <br />ACKNOWLEDGE PROMOTION -CAPTAIN DARRYL BOYKINS <br />In a letter to the Board, Chief Thomas Fautz recommended that Captain Darryl Boykins be promoted <br />to the rank of Division Chief in the Uniform Division. Captain Boykins was sworn in on June 26, <br />1984. During his career he has worked as a Captain in the Uniform Division, in the K9 Unit and in <br />the Office of Professional Standards. It was noted Mayor Steve Luecke approved this promotion. <br />The effective date of this promotion was February 16, 2005. The appointment was acknowledged. <br />APPROVE PROMOTION -CORPORAL CHARLES STOKES <br />In a letter to the Board, Chief Thomas Fautz recommended that Corporal Charles Stokes be <br />promoted to the rank of Sergeant in the Uniform Division. Corporal Stokes was sworn on the <br />Department on June 27, 1982. During his career he has worked in the Patrol Division and in the <br />Homicide Division. The effective date of this promotion was February 16, 2005. Upon a motion <br />made by Mr. Carr, seconded by Mr. Taylor and carried, the recommendation was approved. <br />APPROVE PROMOTION -SERGEANT FRANK STEIGER <br />In a letter to the Board, Chief Thomas Fautz recommended that Sergeant Frank Steiger be promoted <br />to the rank of Lieutenant in the Uniform Division. Sergeant Steiger was sworn in on July 2, 1986. <br />During hiss career he has worked in the Patrol Division, Traffic Division, the Investigative Division, <br />is a member of the SWAT Team and Commander of the Civil Unrest Team. The effective date of <br />this promotion was February 16, 2005. Upon a motion made by Mr. Carr, seconded by Mr. Taylor <br />and carried, the recommendation was approved. <br />APPROVE PROMOTION -SERGEANT MICHAEL SUTH <br />In a letter to the Board, Chief Thomas Fautz recommended that Sergeant Michael Suth be promoted <br />to the rank of Lieutenant in the Forensic Lab. Sergeant Suth was sworn in on Apri12, 1992. During <br />his career he has worked in the Patrol Division, NEST Unit, Investigative Division, Major Crimes <br />Unit and is a former member of the S WAT Team. He is currently assigned to the forensic lab. The <br />effective date of this promotion was February 16, 2005. Upon a motion made by Mr. Carr, seconded <br />1 <br />1 <br />1 <br />
