<br />4-12-10 <br />PUBLIC WORKS AND PROPERTY VACATION COMMITTEE <br />Chairperson David Varner, called the Public Works and Property Vacation Committee <br />meeting to order at 3:50 p.m. <br />Committee Members Present: Tim Rouse, Tom LaFountain <br />Other Councilmember's Present: Ann Puzzello, Oliver Davis, Karen White, Al "Buddy" <br />Kirsits <br />Other's Present: Lisa Bognar, Brad Toothaker, Carl Littrell, Terry Lang, Gary Gilot <br />Agenda: Bill No. 07-10 -Vacate Allen's alley <br />Bill No. 17-10 -Vacate Portion of Laurel Street <br />Bill NO. 12-10 -Vacate Alley at Dunbar Corner <br />Bill No. 07-10 -Vacate Allen's alley <br />This bill would vacate a five foot wide strip of Allen's Alley from Michigan Street west <br />for 165 feet to Woodward Court. This action was deemed necessary to facilitate the <br />completion of the multi-million dollar American Place project Phase I. Prior <br />consideration had been continued to allow for an amicable resolution of access, parking, <br />and outdoor dining issues raised by an adjacent property owner. With these agreements <br />agreed upon as described by Brad Toothaker, the petitioner, he asked for favorable <br />disposition. Council questions revealed while agreements had been arrived at, the final <br />wording had not been signed by all parties. Council Attorney Kathleen Cekanski-Farrand <br />suggested any Council action be subject to these verbal agreements. Gary Gilot, Director <br />of Public Works, added that a new 10 foot wide sidewalk along the pedestrian scale <br />lighting would be part of the project. The cost would be covered from the Downtown <br />TIF. <br />Understandings reached, Councilmember LaFountain moved to send this bill to the <br />Council with a favorable recommendation. Councilmember Rouse seconded and all <br />affirmed. <br />Bill No. 17-10 -Vacate Portion of Laurel Street <br />Chairperson Varner allowed Terry Lang of Lang-Feeney and Associates to make the <br />presentation. Mr. Lang advised that they were working with the Troyer Group who were <br />
