REGULAR MEETING MARCH 10 2010 20 <br />Michael Stuk be promoted to the rank of Corporal effective March 14, 2010. Chief Boykins stated in <br />his letter that all of the candidates have successfully completed three (3) years of service with the <br />South Bend Police Department. Upon a motion made by Mr. Cottrell, seconded by Ms. Vasquez <br />and carried, the recommended promotions were approved. <br />CONSIDERATION OF AGREEMENT AND WAIVER AS TO PROCEDURAL PROCESS FOR <br />DISCIPLINARY ACTION - CHARGES 09 -05 - CHRISTOPHER HOUSER <br />Upon a motion by Mr. Cottrell, seconded by Ms. Vasquez and carried, the Board accepted Chief <br />Boykins recommended six (C) day unpaid suspension as set forth in the Agreement and Waiver as to <br />Procedural Process for Disciplinary Action signed by Board Attorney Thomas Bodnar, and Corporal <br />Houser's Attorney, John Kautzman. Mr. Bodnar noted there would be a letter forthcoming setting the <br />details. <br />APPROVE HEARING DATE - CHARGES 2010 -01 - NICHOLAS MCKINLEY <br />Upon a motion by Mr. Cottrell, seconded by Ms. Vasquez and carried, the Board approved March <br />12, 2010 as the date to set the Hearing for Mr. McKinley. Mr. Cottrell noted the time and place <br />would be determined at a later time. <br />APPROVE REOUEST FOR PAID EXTENDED MEDICAL LEAVE — CAPTAIN RONALD <br />MARCINIAK <br />In a letter to the Board, Chief Boykins, Police Department, stated that Captain Ronald Marciniak <br />requests the Board grant him a paid extended medical leave of approximately forty -two (42) calendar <br />days retroactive from February 23, 2010 to April 5, 2010. Chief Boykins stated in his letter that <br />Captain Marciniak has had some medical problems recently and is not eligible for sick buy back in <br />2009. Upon a motion made by Mr. Cottrell, seconded by Ms. Vasquez and carried, the paid, <br />extended medical leave was approved effective retroactively to February 23, 2010. <br />ADJOURNMENT <br />There being no further business to come before the Board, President Dempsey declared the meeting <br />adjourned at 9:25 a.m. <br />BOARD OF PUBLIC SAFETY <br />rte:, <br />Juanita Dempsey, President <br />_2 r <br />Patrick D.
