The Contractor shall at its cost furnish all tamp renewals and light all <br />lamps herein provided for by electricity .for a period of nine years and four <br />months from and after the lst day of September, 1925 at noun. All of the lamps <br />which shah, be provided nand maintained by this Contractor shall be operated so <br />that they=-will"gl" 'the maximum amount of illumination obtainabld under wommeraid <br />conditions. <br />2. All Lamps hereln prori�ted for shall be burned from one-half hour after <br />sunset until one-half hour before sunrise every night and all night burning, <br />approximately four thousand (49000) o hours per annum <br />.. The number of Lamps furnished and lighted under this contract shall be <br />the number provided for in paragraph 1 hereof. and shall be located as shown on h <br />the blur print attached hereto and indentified icy the signatures of the Consta ote► <br />and members of the Board of Public Works. <br />` 4. All outages shall be reported Ally in writing by the proper officers of <br />the City -to the ContractoR and the propof `bffieers of the City may deduct from th <br />total monthly amount which would have been 'paid for any lamp so reported had no <br />outage ocaured,,the_sum bearing the ratio to snag total as the period of <br />outage bears to the total time the lamp would have been lighted in any month. <br />5. Street lighting units herein contracted for shall be staved by the <br />Contractr to such now location as the City may by writing direot, subject to.-- <br />the following conditions:- ` <br />Such moving of lamps shall be completed within thirty (30) days after <br />receipt by Contraotor.of written notice from the City, Sunday's, legal holidays <br />and stormy days not to be counted., provided that the number of such removals <br />shell not exceed one per day, and provided further that subh removals may not be <br />required on Sunday's legaL holidays and stormy days, Notice that the work of such <br />removal of lamps has been anpleted shall We given by the contractor to the City <br />within ( ten (10.)_.days after the completion of the work. <br />The actual cost, to the Contractor of making sung relocations shall be <br />paid by the City to the ConAractor within thirty (30) days after said notice had <br />been given. <br />6. The City shall.aecept such lamps and the services herein specified durig <br />the life of this contract and pay as full compensation therefor at the rate and p <br />price set out in the accepted bit, to -wit: <br />For underground stree T lighting units. <br />6000 Lumen Incandescent Lamps, Iron Post Egyptian Senior Opalescent unit <br />or equivalent unit. <br />per unit per annum. 70.OD <br />is Payment for all lighting services to be made in equal monthly instollmen <br />ts, each installment; to be due and payable on or before the 20th., of each math <br />.succeeding that in which the service is rendered. <br />7• The Contractor shall have the right with the consent of the Board of <br />Public Works of the City, at aby time during the life of this contract <br />to install, operate and maintain in the place of the lamps herein provided for, <br />and under the same terms and conditions, otheras and more improved lamps in <br />keeping with 'such advancement as may be made in the art of lighting, which lamps <br />shall be of equivalent or greater illuminating power. <br />S. In authorizing or granting a permit to any person, firm or corporation <br />to repair or out into any ztreet, alley, or sidewalk in which said street light <br />ing units and lines and eabhes supplying current thereto are located, the City <br />shall require, as a aciidition to the granting of such permit, an agreement on the <br />part of the dpplicent that sueLa lines and cables and street lighting units will <br />not be interfered with in any manner without notice to the Contractor. <br />9. All the covenants, expressins, terms, conditions, provisions and agree- <br />ments herein shall extend to and be binding upon, or inure to the benefit of <br />is the case may be, each and every -one of the successors or assigns of each of <br />the parties hereto as if in every case so expressed, <br />10. This contract shall be inforee and effect from and after itss approval <br />by ordinance for a period of nine (9) gears and four N) months from and after th <br />the 126tday of September, 1925, at noon. <br />IN WITNESS WHEREOF, the said City of South Bend, Indiana has caused its <br />corporate seal.to be hereunto affixed and iathis contract to be signed by the <br />Board of Bubiie Works of said City and said Indiana & Michigan Elea.
