Cont1 Y,,,, h _ <br />The following, -agreement signed by John Hibberd. <br />Before the Board of public Works <br />of the City of South Bend, Indiana. <br />In the matter of Condemnation Resolution No. 83 <br />for the opening of a street between Colfax Avenue <br />and La Salle Avenue and Lincoln Way West from Marion.St. <br />to Navarre Street, known and W611iam Street. ° <br />The undersigned having heretofore filed remonstrance agafns� <br />assessments of benefits against the prope ty as shown by said assessment roll <br />hereby agrees that if there is a reduction of 30 per -cent made in said assessmet <br />by the Board of Public Works, that they will withdraw their remonstrance against <br />.said assessments and will pay said reducee assessment. <br />Than if said: reduction Is not mace by said Board, said remon- <br />strance will not be affected in any way by this agreement. <br />JOHN B. HIBBERD <br />Sigzted this 2Oth.- d&y- of May 1925. <br />The following report made by the City Engineer. <br />Board of Public Works <br />South Bend, Indiana. <br />Gentlemen: -y <br />We have checked the attached petitions relative to the type of <br />pavement to be used in paving South Michigan Street from a point 230' south <br />of Bronson Street to Broadway, and find that a majority of the resident free- <br />holders have petitioned for sheet asphalt. <br />Respatfully sul5mitted; ° <br />FREDERICK �� ANDERSON <br />City Engineer. <br />Concerning the improvement of the roadway of Michigan Street <br />from a point 280 feet south of Bronson Street; to north curb line of Broadway <br />in pursuance to Resolution No. 1451 the petition of freeholders residiAg on said <br />street is monsidered, and the report of -the City Engineer is receivo' and all <br />evidence is heard, and the Board of Public Works finds that said petitioners <br />constitute a majority in number of the freeholders residing upon said street:to <br />to improved, and that.said petition is,sufficent and it is therefore cronsiderad <br />and adjwMed that said improvement be made with Sheet, asphal"L the kind of pave- <br />ment requested In -said petition; and the City Engineer reports that Rieth-Riley <br />Company is -the lowest afidbest bidders for said pavement, and the Board -, *so, <br />finds, and letsthe consiraot for said improvement to him, and orders said im- <br />prvvement ko be made with Sheet asphalt using Mexican asphalt and all proceeding <br />heretofore had in this matter are hereby confirmed and ratffied. <br />Concerning the improvement of the roadway of Altgeldt Ave. <br />from Mibmi,Street to Marine .Street with asphalt, asphaltic oonorete, bitlithic <br />aonorete,or,briek, in pursuance to Resolution No: this being -the date set for <br />the making of the preliminary ardor designating the kind of pavement the Boards - <br />at 1000 A.M. Tuesday May 19th.0 1925 publicly ordered read and considered all <br />bids and then Continured thiir meeting to Wednesday May 2Oth., 1925 at 7:15 P.M. <br />Now on last named date.the Board designated Sheet asphalt <br />as the kind of.pavement with which said street is to be improved with and fiexes <br />the 2nd.,day of June 1925 at 10:00 A.M. as the time when the petitions for <br />changing the kind of pavement,muss, be filed, and the Board hereby continues <br />trhis, mutternt1 ,the 3rd. day of June 1925 at 17O:O0 A.M. on the day above named <br />the Board will either pass on petitions let said contract or reject all bids <br />c <br />
