<br />CONSENT TO LAY ADDITIONAL TRACKS.
<br />To the Honorable Mayor,,Common Council, and Beard of Works of the City of South Bend.
<br />Your petitioner, the New Jersey, Indiana & Illinois Railroad Company,
<br />,respectfully shows,by this, its petition:
<br />1. That said petitioner is a corporation duly organized and existing
<br />under and by virtue of the.laws of the State of Indiana for the purpose of ,operating a.
<br />steam railroad and particularly organized and existing under and by virtue df the general
<br />laws of the said state pertaining to the organization and existence of steam railroads.
<br />2. That said petitioner is duly authorized to maintain and operate its
<br />p resent steam railroad in the City of South Bend under and by virtue of Ordinance Number
<br />1250 adopted by the Common Council of the City of Sough Bend, February 28th, 1904, and
<br />Ordinance Number 2100, adopted by the Cameron Council of the City of South Bend, July 12th,
<br />1920.
<br />3. Your petitioner further respectfully shows that it ownsa operates and

<br />controls a steam railroad in the said State of Indiana, and particularly said

<br />St. Joseph County, in said State, and in and from the station of Pine in sCounty in
<br />a northerly dir ction in and to the City of Suouth Bend, and is a common carrier of freigh
<br />and passengers for hire; both in state and interstate commerce: and that its liine of
<br />railroad connects with and furnishesintercharnge of traffic with other lines of railroad
<br />engaged -.in such commerce: that in order to provide accommodations necessary to accomplish
<br />the purpose for which said Company was incorporated, and in order tO furnish proper and
<br />adequate public_i'acilities in the discharge of its duties as such oommon carrier, and for
<br />the purpose of improvement of its read by the construction of additional yard facilities
<br />and team tracks,, it has become and is necessary and desirable that the said petitioner
<br />construct, operate and maintain across Huron Street, two additional switch or yard tracks
<br />in said City; that said petitioner has, for many years owned the fee simple title to the
<br />necessary lands therefor. And petitioner says that it desires and intends to use such
<br />additional siege or yard tracks, and `the land obtainedtherefor for railroad purposes
<br />in the staring, receiving, ]candling.°and deliveyy of freight, and to put the same to such
<br />uses a s such yard tracks and facilities are generally put in the operation of a steam
<br />railroad as a public earrer.
<br />4, That both of said additional tracks will stand upnn land owned by
<br />petitioner; that the exact location of said tracks is more specifically shown by a map
<br />attached hereto and made a part of this petition.
<br />WHEREFORE this petitioner prays that it be granted permission to con-
<br />struct, maintain and operate said additional tracks across Huron Street in the City of

<br />P.ESOLVED, by the Board of Public Works in the City of South Bend, Ind-
<br />.iana, that the petition of the New Jersey, Indiana & Illinois Railroad V®Mpany heretofo r4
