Continu <br />It <br />{ <br />MADISON PARK <br />The annexed plat is a plat of Madison Park, <br />an addition to the City of South Bend, St. Joseph County, <br />Indiana, which covers the following described tract of <br />land situated in the Southwest quarter of Section 6, Town- <br />ship 37 North, Range 3 East, to -wit: <br />Commencing at the South line of said section <br />at a point seven hundred and thirty and five <br />tenths (730.5) feet West of the Southeast cor- <br />ner of said quarter section; thence North <br />thirteen hundred and nine and fifty-nine hun- <br />dreths (1309.59) feet; thence South seventy-six <br />degrees and twelve minutes West (76 ° 121)seventy- <br />five and two tenths (75.2) feet, thence North <br />Twenty and five tenths (20.5) feet; thence South <br />seventy-six degrees twelve minutes (766 <br />121) West <br />three hundred and fifty-three (353) feet along the. <br />Southerly line of Sorin Street to an angle in said <br />street; thence West two hundred and one and eight - <br />tenths (201.8) feet along the South line of said <br />street; thence South twelve hundred andtwenty-seven <br />and sixty-five hundreths (1227.65) feet to the South <br />line of said section thence East six hundred and . <br />seventeen and five '-tenths(617.5) feet to the Place <br />of beginning. <br />The plat contains ninety lots numbered from <br />1 to 90 inclusive. <br />The size of the lots and the width of the streets <br />are marked on the plat in feet and. fractions. All alleys <br />are fourteen feet wide. The streets and alleys are hereby <br />dedicated to the public .for the use of the public as thorough- <br />fares. <br />-BUILDING RESTRICTIONS <br />Be it known that all persons, natruall or artificial, <br />who shall hereafter acquire any interest in any lot in said <br />addition, shall be taken and held to agree with the grantors, <br />and with the owners of any and all of the other lots in said <br />addition, to conform to and observe the following covenants <br />and,restrictions and stipulations at least until January 1, 1950 <br />at which timeaall or any of such restrictions may be revoked or <br />repealed only by the written consent, duly recorded, of the <br />owners of a majority of the frontage on that part of any particu- <br />lar street affected that lies within the limits of this plat. <br />Each and all of the restrictions herein set forth shall run with <br />the land and bind the present owners, their successors, assigns, <br />heirs; executors, and administrators, and all persons claiming <br />by, through or under them, shall be taken to hold, agree and <br />covenant with the owners or owner of said lots, their successors, <br />assigns, heirs, executors, administrators, and each of them <br />to comply with and observe said restrictions as to the use of <br />said ots and the consrtucion of the improvements hereon, but <br />n estrictions herein set forth shall be personally binding <br />��n any person except in respect to breaches committed during <br />j <br />his ownership of such lot or lots. <br />The owner of any lot in said addition shall have a <br />right of action to enforce the provision of .these restrictions <br />or prevent their violation, and the failureto enforce any or <br />all of the restrictions herein set forth 6iall in no eeivent <br />
