2zs <br />Wednesday April 9th, 1924. <br />, Board met in special,session at ll 10 A.M. All members present: also <br />present: Mayor Eli F. Seebirt,-City Civil Engineer Anderson; also Engineer Reinsagen, Genes <br />Superintendent W. F. Schaff and Attorney John G. Yeagley of the New York Central Railroad. <br />Attorney Buczkowski appeared and presented a petition for Northern Indiana <br />Wholesale Grocery Company regarding trick elevation at Arnold -Street and at Walnut and <br />e <br />Division Street ros.s"ings of New York Central Lines, asking that prevision ire made in Res- <br />plution No.. 4 for the separation of ,the grades of at - least two. of mentioned crossings. <br />Same placed on file. <br />Conversation was held between the Board, Meyer, City Engineer, Mr. Schaff, <br />Mr. Reinsagen and Mr. Yeagley regarding Now York Central Railroad assuming the cyst of <br />opening new street north of Sample Street from Fellows Street to ,Clinton Street; also as- <br />suming the cost of purchasing property for a new street north of Sample STREET and pur- <br />e hathing necessary property to rearrange Marietta and Ohio Streets where they cross tracks. <br />Mr. Schaff requested time to submit above :proposition to New York Officials of Railroad. <br />Reques't granted by the Board, who asked for a report by May.7th, 1 4. Hearing continued <br />until May 79 1.924 at 9:00 A.M. <br />Pre sid t <br />Wednesday April 9th 1924, 7:15 P.M. <br />Board met in -regular session at 7*15 P.M. Allmembers present: Clerk of <br />Board absent.. <br />Hearing given on Condemnation Resolution No. 88 for the opening of Colfax <br />Avenue from EDDY Streetle Sunnyside Avenue in the City of South Bead, Ind.iama. <br />In the above matter no remonstrators appeared and nowritten remonstrance <br />was filed. Mr. Witwer, representing Studebaker Estate, Mr. Falter Mclnerny and VitUs Jones <br />.appeared in favor of improvement. The Board therefore sustain all former action taken, <br />and declare the above described property in all things condemned and appropriated for <br />public use and this resolution'in all things, ratified, confirmed and approved. <br />The Board further ordered that the City Engineer be:instructed t, prepare <br />a roll of all owners or holders of property and of valuable interests therein tit to <br />be taken or to be injuriously affected which list or roll shall also describe the property <br />beneficially affected acid show the awards of damages and' assessments of benefits in the <br />above matter. + <br />Hearing given on Condemnation Resolution No. 86 for the opening of Coil ego <br />Street from Hamilton Street to Bergan Street; also Brookfield Street, from Hamilton Street <br />to south line of Bergan STREET; also Brookfield 'Street from north'line of Bergan Street to <br />south line of Wilson Stvoot;' also Johnson Street from Hamilton Street to Wiikon Street, xxt_ <br />the City f South Bend, Indiana. <br />In' the above a tter'remonstrators appeared and Attorney Ed Doran filed <br />written remonstrance. The'Board thereupon sustain all former action taken, and declare <br />the above described property in all things condemned and appropriated for public use and.- <br />this resolution in all things, ratified, confirmed and approved. <br />The Board further.ordered that the City Engineer be'instructed to prepare <br />a rill of all owners or holders of property and of valuable interests therein sought to., <br />be taken or to be injuriously affected, which list or roll shall alto describe the <br />property beneficially affected and show the awards of damages and assessments of benefits <br />in the above matter. <br />Hearing given on Condemnation Resolution NO. 87 for the Opening of Elmer <br />Street from the north line of Marquette Heights Addition to Wilson Street in the City of <br />South Bend, Indiana. <br />In the -above mutter Dan Pyle appeared and -filed a remonstrance. No other <br />remonstrators appeared and no other remonstrance was filed. The Board thereupon sustain <br />all former action taken, and declare the above described property in all things condemned a <br />and appropriated -.for public use and this resolution in all things, ratified, confirmed <br />and approved. <br />The Board further"ordered that the City Engineer be instructed to prepare <br />a roll of all owners or holders of property and of valuable interests therein sought to <br />be taken or to be injuriously affected, which list or roll shall also describe the <br />property beneficially affected'and show the awards of damages and assessments of benefits <br />in the above matter. <br />
