15L <br />Tuesday Nobah 4th. <br />1924, Continued. <br />Mr..Kidder appeared before the Board and presented petition for the <br />paving of Thirty Fourth Street from Mishawaka Avenue to Grand Trunk Western R g,Co <br />Same placed on file until later in the season, <br />The Board appointed the following partles to act as appraisers of <br />property on the Opening of William Street, Condemnation of band for easements for <br />.trunk sewer also Vacation of St. Peter -Street. - Philip Borrdurant, Frank J. Anderson <br />and Ed Neddo. <br />' Renewal certificate of ThM art Brothers for $1,000.00 approved. <br />Request of Indiana & Michigan Electric Company in regard to tranferring <br />line' of poles on West Ealing °Avenue to, the intersection of Kemble Avenue, reported <br />on as follows:- This change will be a great improvement to Ewing Avenue and.I <br />recommend that -the regmest be granted. Wm. F. Qua31s. Inspector. <br />Mr. Chas. Wattles, representing H. A. Wodd Realth Co;., appeared. and <br />filed petition as follows: <br />H. A. Joseph County 44 <br />Before the Board of Public Works. <br />To the Honorable Board of Public Works of the City of'touth Bend: . <br />The undersigned petitioner represents and shows to the Board as fol- <br />lows: That it is the respective owner of each of the following lots in Wood s <br />Subdivision of Lot 67 Marquette Park Addition to the City of South Bend, State of <br />In# ana : <br />NAME OF OWNER LOT NUMBER <br />H. A. Wood Realty Companyt A, B, C, D and E. <br />That the certain tract of land namely Lot 6 of which all of said lots are <br />s part was duly assessed in wh&le or in part fdr the fo?lowing public imprivements <br />in the City of South Bend, to -wit: <br />Portage Avenue Grading No. 1008. <br />Portage Avenue Trunk sewer No. 1015. <br />Porge Avenue Asphalt pavement No. 1030. <br />THOMPSON Ave. Wilber St. Stocker Place Adams ST., and College -St.,' <br />Mexican hheet Asphalt Pavement -No. 1270. <br />that the legal description of said tract of land.is as follows: <br />Lot No. 67 in Marquette Park Addition to the City of South Bend, <br />gild improvement assessments which were so levied against said real <br />estate and the amount and name of each -of said assessments which are now unpaid, and <br />the number of installments thereof which are now unpaid are fklgd #e;ewith a;.d made <br />a part of this petition and are marked respectively Exhibits A B and "C . <br />That after said -assessments were levied against said land the same was <br />replatted,and theo plat thereof has been �pproved as required by law and is known and <br />described as "Wood s Subdivision of Lot / Marquette Park Addition to the City'of <br />South Bend, Indiana, " and is recorded in Plat book at page in the Office <br />of the Recorder of St. Joseph County, in said State. <br />Your petitioner further says that there is no interest now due on any of <br />said assessments; and there are no penalties or carats due thereon. <br />=In the event that a re -assessment shall be made as herein requested the <br />undersigned petitioner and lot owner hereby authorizes Miller Guy, its Attorneyin <br />Fact to sign and enter into an Agreement and Waiver in writing, n the form and <br />manner provided by law to be approved by the said Board of Public Works, for the <br />�Ejvieldege of paying such improvement re -assessments in the number of instalments re - <br />or the remainder of the ten (10) year period granted under the original <br />improvement asse'ssmyente for said iinprovements; it being agreed' and understood that <br />the undersigned H. A. Wood Realty Company,=shall pay iD full all such unpaid in— <br />stallhsnt,s of said re -assessments as the same shall become due a ainst' the said lot <br />above described together with all costs and penalties that may bf added thereto, and <br />ali interest thereon, <br />WHEREFORE your petitioner requests your Board td. reassess the unpaid <br />amount of each of said improvement assessments, Including all unpaid interest thereon <br />so that each lot or a tract of'land of the - said new Subdivision, as shown by the <br />approved.plat thereof shall bear its fair and equitable proportion of each original <br />unpaid assessment, and all interest then due thereon and all penalties and costs, if <br />
