and southerly rails of said tracks shall respectively be descending grades of six (6) <br />feet to each one hundred (100) feet until they intersect the present street grades of Miami <br />Street. The grade of Brook Street which intersects Miami Street on the west side shall be <br />changed so as to conform to the grade of Miami Street and then descend at the rate of eight <br />(8) feet to each one hundred (100) feet until'it intersects the present grade of Brook <br />Street. . <br />(26) The.grade of Marine Street,where the same intersects the tracks <br />of said railroad shall be raised three and three i,enth (3-_ 10) Feet glove the top of the <br />highest rail of said tracks as now maintained, and the trakks of said Company across said <br />street shall be raised to conform to the grade of said street when changed as provided <br />herein. 4 <br />(27) The tracks of.the GRAND' TRUNK WESTERN RAILWAY COMPANY and the -NEW YORK <br />CENTRAL RAILROAD COMPANY at Vhepoint where they cross just east of Arnold Street shall be <br />raised six and one ahlf,(6 ) feet above the top of the rails of the orpssing frogs as now <br />maintained at said crossing; and the tracks of said railways shall be raised to conform to <br />the grade of said crossing point when changed as provided herein.* <br />(28) The grade of DIVISION STREET shall be changed, beginning at a point one <br />hundred (100) feet east of the east line of Pine Street and then ascending seven tenths <br />(0.7) of a foot in each one hundred (100) feet to the west line of Laurel Street, at.which <br />point the raise in the grade of Laurel Street shall not exceed three and four tenths (34) <br />feet above the present grade of the tracks of the Grand Trunk Western Railway 0ompany, <br />The gRade of Division Street; from the lAst above mentioned point, shall be a descending <br />grade 6 five (5) feet in each one hundred (100) feet, until it intersects the present <br />grade of Division Street west of Laurel Street; and the grade of Laurel Street shall be change <br />so as to Sonform to the grade of Division Street, and on each side of Division Street shall <br />be descending grades of five (5) feet to each one hundred (100) feet, until they intersect <br />the present street grades of Laurel Street. The grade of Pine Street which intersects <br />Division Street and the tracks of the Grand Trunk Western Railway'Companys shail_.be changed so <br />as to conform to the grade of Division Street as hereon established and shall descend from <br />each side thereof at the rate of five (5) feet in egoh one.bundrtd 1100) feet, until it inter- <br />sects the present grade of Pine Street. <br />(29$ That the tracks of the different railroads herein referred to shall be <br />raised so as to conform to the different street grades as herein fixed. <br />t(30) That all streets over which the tracks of the New York Central Railroad <br />Company are Required Uy this resolution to be raised or elevat*dt shall have the full <br />amount of the elearnace as provided for in -this resolution for each of said streets forthe <br />full width beneath the superstructure, an4---that at all points where there is a change in <br />the direction of street 'grades as fixed above suitable allowances shall be made for vertical <br />curves. <br />(31) And.the tracks of the Terre Haute and Logansport Railroad Company <br />now Pennsylvania Railroad Company), Indiana Northern Railway CompAnys Oliver Chilled Plow <br />Company and Studebaker Corporations whose trasekw interseot.or connect with the tracks of the <br />New York Central Railroad Company, if said companies of any them, shall desire to keep and <br />maintain said eonnneetions, shall be raised so as to conform to the grades of said New York <br />Central Railroad Company as herein established and mage proper connections with saute. <br />(32) That the said improvement shall be made and paid for sccording to the <br />method and manner provided for in an Act of the General.Assembly of Indiana of 1923, Page <br />110, or any other law applicable thereto. <br />TYat the Chicago, South Bend and Northern Indiana Railway Company, which <br />maintains street car tracks at Chapin.Street and Michigan Street, where the same intersect <br />the tracks of said Railroad.Company be and is hereby'ordered to reconstruct its tracks accord- <br />Igg to the grades herein provided fors and shall pay five (5) per cent -Of the cost of the <br />alteration of such grade crossings at such intersections. <br />All other resolutions heretofore adopted by the Board of PUblie Works <br />for the separation of tracks from the grades of any streets be and are hereby rescinded. <br />BE IT FURTMERESOLV'ED, That notice of the time and place for public <br />consideration of this resolution be given in the manner provided by law. Notice of this <br />resolution shall be published on the 2nd. day of February 1924 and on the 9th. day of <br />February 1924 in the South Bend Daily Tribune and the South Bend News Times. <br />Adopted this 29th. day of January 1924.
