KAREEMAH FOWLER <br /> CITY CLERK,SOUTH SEND,IN <br /> AN ORDINANCE OF THE COMMON COUNCIL OF SOUTH BEND,INDIANA, <br /> ADDING SECTION 20-4 OF CHAPTER 20,ARTICLE 1 OF THE SOUTH BEND <br /> MUNICIPAL CODE TO ESTABLISH PARKING RESTRICTIONS ON SOUTH BEND <br /> CITY STREETS. <br /> STATEMENT OF PURPOSE AND INTENT <br /> Indiana Code 9-21-1-3 provides local authorities, with respect to private roads and <br /> highways under the authority's jurisdiction, and within the reasonable exercise of the police <br /> power of the authority,the power to regulate the standing or parking of vehicles for the purposes <br /> of safety and the expediting of traffic flow. <br /> In the interests of both expediting the flow of traffic and the safety of 1)persons operating <br /> vehicles on such private roads and highways; 2)persons operating vehicles entering onto such <br /> private roads and highways from alleys or driveways; and 3)pedestrians, the standing, stopping, <br /> or parking of motor vehicles should be prohibited in designated areas. This ordinance adds § 20- <br /> 4 to the South Bend Municipal Code and identifies those areas in which standing, stopping, or <br /> parking vehicles is prohibited. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA, as follows: <br /> SECTION I. Chapter 20, Article 4 is hereby amended to include Section 20-4 to read as follows: <br /> Sec. 20-4 Designated Areas Where Stopping, Standing, or Parking Prohibited <br /> No person may stop, stand, or park a vehicle, except when necessary to avoid conflict <br /> with other traffic or to avoid conflict with law or the directions of a police officer or traffic <br /> control device, in any of the following places: <br /> 1) On any sidewalk or parkway. <br /> 2) In front, or within four(4) feet, of either side of a public or private driveway as <br /> defined in Section 14-41 of the South Bend Municipal Code. <br /> 3) Within an intersection. <br />
