KAREEMAH FOWLER CITY CLERK,SOUTH SEND,IN AN ORDINANCE OF THE COMMON COUNCIL OF SOUTH BEND,INDIANA, ADDING SECTION 20-4 OF CHAPTER 20,ARTICLE 1 OF THE SOUTH BEND MUNICIPAL CODE TO ESTABLISH PARKING RESTRICTIONS ON SOUTH BEND CITY STREETS. STATEMENT OF PURPOSE AND INTENT Indiana Code 9-21-1-3 provides local authorities, with respect to private roads and highways under the authority's jurisdiction, and within the reasonable exercise of the police power of the authority,the power to regulate the standing or parking of vehicles for the purposes of safety and the expediting of traffic flow. In the interests of both expediting the flow of traffic and the safety of 1)persons operating vehicles on such private roads and highways; 2)persons operating vehicles entering onto such private roads and highways from alleys or driveways; and 3)pedestrians, the standing, stopping, or parking of motor vehicles should be prohibited in designated areas. This ordinance adds § 20- 4 to the South Bend Municipal Code and identifies those areas in which standing, stopping, or parking vehicles is prohibited. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. Chapter 20, Article 4 is hereby amended to include Section 20-4 to read as follows: Sec. 20-4 Designated Areas Where Stopping, Standing, or Parking Prohibited No person may stop, stand, or park a vehicle, except when necessary to avoid conflict with other traffic or to avoid conflict with law or the directions of a police officer or traffic control device, in any of the following places: 1) On any sidewalk or parkway. 2) In front, or within four(4) feet, of either side of a public or private driveway as defined in Section 14-41 of the South Bend Municipal Code. 3) Within an intersection.
