<br />improvement in 71ilber t'treet from Lincoln Way West to Elwood Avenue, in Accordance with
<br />the terms of the contract between the City and. George Harropp, contractor, under Improve
<br />ment 'Resolution No.I939,. The Board signed and approved same in the amount of $3,662.72
<br />City Engineer, filed his- report of the remonstrance against the grading
<br />of the alley west of Mimai Street from Irvington to Fairview under Improvement Resolutie
<br />No.I975. This report showed that there are five resident property owners residing on tt
<br />proposed improvement, three of whom have signed the remonstrance and while the law, does
<br />not give the owners a right to remonstrance against any grading mprovement-,;i in view
<br />Of the fact that the majority of resident property owners do not favor this improvement,
<br />the Board decides to rescind all former action on said improvement resolution No.I975
<br />and declares same hull and void and the proceedings closed.
<br />The Board approved the Guarantee bond of Rieth Riley Const., Company for
<br />the pavement on .Lincoln V1ay from Cottage Grove Avenue to Wilber Street under Improvement
<br />Resolution TdO.IU4. The bond of 9,336.63 is W- of the construction cost, signed by
<br />the Southern Surety Co.
<br />The Board approved the following renewal certificates for excavation and
<br />contractors bonds:
<br />Albert W. Smith, signet by Metropolitan Casualty Insurance Co.
<br />Edward J. ;White, signed by the Fidelity and Deposit Co.
<br />Jacob Hawblitzel, signed by the Aetna Casualty and Surety Co.

<br />City Engineer, 11r. H. G.iiray, filed plans, specifications and estimate and
<br />the Board adopted a resiblution for the pavement of Peashway street from Leeper Avenue to
<br />Southern Michigan Railway right of way under Improvement Resolution No. I980. (See files
<br />for copy of resolution.)
<br />In the above named resolution, the Board hereby orders that on�the Ilth. day of January, I928, . this Board wdll meet in their office in the City :Hall at 7-I5 P. y'&!
<br />to hear and receive remonstrances from all persons interested in or affected by said
<br />proceedings and will decide whether the benefits to. the several lots and parcels of land; 1
<br />liable to be assessed for said improvement will be equal to the estimated cost of same as r
<br />reported by the City Engineer. The Board further orders that notices of said hearing shall
<br />be published -_on the 3rd. , day of December and on the 30th. , day of December I927 in the
<br />South Bernd News Times and Tribune,qnd that notices be mai&ed according to lawn.
