Romig, the Board approved <br />and accepted a deed for a strip of land from Koehler, Bernard and Louise, which is <br />a description of the property necessary for the widening of McKinley Avenue from Sunnysi e <br />East. <br />On account of certain admissions made in the presence of and to the <br />Board of Public Works by Mr. L. H. Webster on Tuesday morning, September 20th., I927* <br />in regard to sewer work performed by him that was deficient and otherwise contrary to <br />plans and specifications, the Board, hereby, rescinds it's action in the matter of the <br />award of McKinley Avenue local sewer from 22nd., Street to Greedlawn Avenue under <br />Improvement Resolution No.I9I9 and upon the advise of City Attorney, Mr. I. S. Romig, <br />authorizes the advertising of new bids and accordingly rejects all bids received for <br />this particular improvement. <br />. The Board"now orders that on the Ilth., day of October, I927, this Board <br />will receive, open and consider sealed proposals for the construction of the local sewer <br />on McKinley Avenue from 22nd., Street to Greenlanw Avenue under Improvement Resolution <br />No.I9I9, up to I0:00 A M. The Board further orders that notices of said proposals shall <br />Abe published 29th., day of Septmber and on the 6th., day of October, 1927, in the South <br />Bend Nears Times and Tribune. <br />j The Board signed the following agreement with the Chicago, South Shore <br />j and South Bend Railroad <br />"Agreement" <br />I <br />This agreement made and entered into by and between the City of South <br />Bend, an incorporated City of the State of Indiana, by and through its Department of <br />Public Works, and Chicago, South Shore ahs South Bend Railroad, an Indiana Corporation,. <br />I� Witnesseth: <br />That the Department of Public forks of the City of South Bend does by <br />li this agreement grant to the Chicago, south Bend and South Shore Railroad, authority to <br />maintain, construct and operate three sput railroad tracks within the City of South <br />Bend, otrer, upon and across Sycamore Street north of the intersection of said Street <br />with LaSalle Avenue in said City, as shown upon the blue print attached hereto, make_ <br />a part hereof and marked Exhibit "A". <br />This grant is made upon the express condition that the said three spur <br />tracks across said street shall be constructed so as to conform with the established <br />grade of said street, and upon the further express condition that said Chicago,,South <br />Shore and South Bend Railroad shall plank the street between the rails of said"tracks, <br />and for two feet on the outside of said rails, with planks not less than two inches <br />-in thickness, which shall, at all times, be kept securely in place and to the grade of <br />said street, and shall, in the maintenance of said tracks comply with the laws of the <br />State of Indiana and the ordinances of the City of south Bend. <br />In witness whereof, the Department of Public ''forks, acting for and In <br />
