In both -of the above assessment rolls the Board hereby orders that on the IIth day of h1ay, 1927, this Board at it's office in Will the City will meet at 7-15 PO v9s, to hear and. receive remonstrances from all persons whose property has been assessed for said improvements and will decide whether the several lots and parcels of land have been or iAA11 be benefited in the amounts shown on said rolls or in a greater or less degree* Board further orders that notices of said hearings be published on the 5th. 1. day of May and on the 6th. . day of May, 1927 in the South -bend News - Times and Tribune. This being the date set, continued hearing was had on Improveipent resolution No. 1794 for the construction of sewer along Johnson Street from Hamilton Street to.Wilson and on Bergan Street from Johnson Street to Portage Avenue. In the above matter, u-non the advise of City Att�brney I. S. Romig, the Board hereby declares the above named resolution null and void. According to the Indiana Statute, it is illegal for the Board to enter into a contract for the construction of a sewer within one year from the date of the rescinding of a resolution for this improvement. Under date of March 23rd., 1927P the Board rescindtd action on a resolution for the construction of a sewer on the above named streets and the Board, therefore, is unable to do anything further until the year has elapsed City Engineer, 11r. H. G. Wray. -I.- filed plans and specifications and the Board adopted a resolution for the construction of a kocal sewer on _'-Voodside Street from Twyckenham Drive to Ridge Road under Improvement Resolution No.I838. In the above matter, Twyckenham,.Land and Investment Co., sole owners of the property to be improved, waived all objections on and in defense to any defect in said proceedings and to any violation in procedure for improvements accord ing to law. Twyckenham Land and Investment Co., Iffiled an easement for the construction of this sewer on Woodsode Street from Twyckenham Drive to Ridge Road. Easdment as follows: In consideratiog of the city of South Bend making an effort-to-sewew the following described land and the right to tap in and use the sewers and the benefits to be derived therefrom, the Twyckenham Land and Investment Co., a Deleware corporation with offices in.the City of South Bend, St. Joseph County, Indiana, does hereby grant to the City of ' South Bend'. Indiana, the right to lay, maintain, op.erate and repair certain sewers as shovm on the attached blue print. This grant of easement on the part of the Twyckenham. Land and Invest- ment Co. will not preclude the city from assessing the land of said company When a sewthe line of said easement, sewer has been constructed along 4 as other lands are assessed as provided by statute, and no deduction rebate or concession will be claimed or asked by said company in consideration for the grant of this easement.
