27 <br />Tuesday 'orning; I -Tay 3rd. , 1927. <br />• <br />Assessment roll for the construction of grade, curb and walk on the north side <br />of Prast Street from Johnson Street- to 2nd., alley west of Johnson Street under <br />Improvement Resolution No.I758. AAmount due Eston Bell, contractor, 248.00. <br />In both -of the above assessment rolls the Board hereby orders that on the IIth <br />day of May, 1927, this Board at it's office in the City Will will meet at 7-I5 P. V , <br />to hear and. receive remonstrances from all persons whose property has been assessed <br />for said improvements and will decide whether the several lots and parcels of land <br />have been or ,Prtll be benefited in the amounts shown on said rolls or in a greater <br />or less degree. Board further orders that notices of said hearings be published <br />on the 5th. , day of May and on the 6th. , day of May, 1927 in the South Bend News - <br />Times and tribune. <br />Teeting adjourned at 12 O'Clock. <br />attested: <br /><71 <br />.erk of the Board <br />Wednesday Evening, May 4th., 1927. <br />Board met in regular session at 7-I6 P. 1. All members present. <br />This being the date set, continued hearing was had on Improvement <br />resolution No. 1794 for the construction of sewer along Johnson Street from Hamilton <br />Street to -Wilson and on Bergan Street from Johnson Street to Portage Avenue. <br />In the above matter, upon the advise of City Att�ortney I. S. Romig, <br />the Board hereby declares the above named resolution null and void. According <br />to the Indiana Statute, it is illegal for the Board to enter into a contract for <br />the construction of a sewer within one year from the date of the rescinding of <br />resolution for this improvement. Under date of March 23rd., 1927, the Board <br />rescindbd action on a resolution for the construction of a sewer on the above named <br />streets and the Board, therefore, is unable to do anything further until the year I� <br />has elapsed, <br />City Engineer, hdr. H. G. :gray;_ filed plans and specifications and <br />the Board adopted a resolution for the construction of a kocal sewer on `ofoodside <br />Street from Twyckenham. Drive to Ridge Road under Improvement Resolution No.I838. <br />In the above matter, Twyckenham.Land and Investment Co., sole owners <br />of the property to be improved, waived all objections on and in defense to any <br />defect in said proceedings and to any violation in procedure for improvements accord <br />ing to law. <br />Twyckenham Land and Investment Co., filed an easement for the <br />construction of this sewer on Woodsode Street from Twyckenham Drive to Ridge Road. <br />Easiment as follows: <br />In consideratio# of the city of South Bend making an effort to sewew <br />the following described land and the right to tap in and use the sewers and the <br />benefits to be derived therefrom, the Twyckenham Land and Investment Co., a Deleware <br />corporation with offices in the City of South Bend, St. Joseph County, Indiana, does <br />hereby grant to the City of South Bend, Indiana, the right to lay, maintain, operate <br />and repair certain sewers as shovm on the attached blue print. <br />This grant of easement on the part of the Twyckenham Land and Invest- <br />ment Co., will not preclude the city from assessing the land of said company when <br />a sewer has been constructed along the line of said easement, as other lands are <br />assessed as provided by statute, and no deduction, rebate, or concession will be <br />claimed or asked by said company in consideration for the grant of this easement. <br />Said sewers shall be laid along and through the above described, real- <br />
