<br />Board met in regular session at 7-I5 P. M. All members present.
<br />.The Board approved the following Guarantee Bonds:
<br />pavement on Oakside Street ._
<br />Guarantee Bond for the eet from Michigan Street
<br />.to Fellows Street under Improvement Resolution No..I609, signed by the Reith Riley
<br />Construction Co., contractors; and The Southern Surety Co., for 10% of the amount
<br />of the contract price, 1.4I7.35.
<br />Guarantee Bond for the pavement of -Esther Street fr&m Jefferson -Street
<br />to Mayne Street under Improvement Resolution'No:I596, signed by The Williston Construct
<br />ion Co . , contractors, and Inland Bonding Co., for I0% of the. amou:}t of the contract
<br />price, 463070:
<br />The Board approved the following Occupancy Bonds-,
<br />George D. Hartman, contractor, signed by the Metropolitan Casualty Co.,
<br />and The H. G. Christman Co., signed by The Standard Accident Insurance Co.
<br />This being the date set, hearing was had on the pavement of the alley
<br />East of Lincoln Way East.from Harper Court to second alley South, thence to Lincoln
<br />Way East, under Improvement Resolution No.I749.
<br />In the above matter, City Engineer, Mr. H. G. Wray, reported on the
<br />remonstrance against.said improvement, which was filed October I2th., I926, as follows:
<br />"There are twenty resident property owners -residing on t his.alley., eleven
<br />of whom have signed the remonstrance. This constitutes a majority and accordingly
<br />I would recommend that no further action be taken on this improvement."
<br />Upon hearing the above report, the -Board -hereby decides to rescind all
<br />j former action of said improviement resolution, adopted on the 28th., day of September,
<br />I9261 end declare same null and void and the proceedings closed.
<br />Upon the recommendation of City Engineer, Mr. H. G. Wray, the Board
<br />approved the grades Par the following alleys:
<br />First alley South of Monroe Street from Columbia Street to alley east
<br />of Columbia Street.
<br />Alley East of Michigan Street from Oakside Street to Woodside street.
<br />Alley East of Columbia Street from South Street to second alley North
<br />of South Street.
<br />Second Alley south of Monroe Street from Columbia Street to Fellows Street.
<br />The Board approved the Drive way for the South Bend Nash Motor Co., on
<br />Lincoln Way East.
<br />This being the date set, continued hearing was had on -the Assessment roll
<br />for the Pipe sewer on Cedar Street under Improvement Resolution No;I656. In the above
<br />matter, no guarantee bond having been filed covering -this contract, and the'Board
<br />decides to continue hearing on same for another week, or until October 27th., I926.
<br />This being the dace set, hearings were had on the following Assessment
<br />Rolls:
<br />-- Curb, sidewalk and pavement on -Esther street from Jefferson Street to
<br />Wayne Street under Improvement Resolution No.I596.
<br />Pavement on Wayne Street from Harriett Street to Eighteenth Street under
<br />Improvement Resolution No.I597. I
<br />Grade, curb and walk on y°ilber Street from Lincoln Way West to Elwood
<br />Avenue under Improvement Resolution No.I565.
<br />Pavement of the center strip on Portage Avenue from Keller Street to
<br />Wilson street under Improvement Resolution No.I692.
<br />Pavement on Phillippa Street from Division street to the N. J. I. & I.
<br />R. R. under Improvement Resolution No.I6I9.
<br />Pavement on Oakside Street from Michigan Street to Fellows Street under
<br />Improvement Resolution No.I609.
<br />In all of the above matters, no remonstrators appeared and n.o written
<br />remonstrance was filed and the Board being fully advised in the premises, finds that
<br />the lots and tracts of land which have been assessed for said improvements on the
<br />above -rolls, have -been benefited in the amounts as shown on said rolls, and therefore,
<br />The Board declares said rolls October. I2th., and October I3th., I926, in all things
<br />ratified, confirmed and approved and the proceedings closed.
