1 9 6. <br />9 <br />• <br />• <br />0 <br />Street. <br />Board met in special session at 7:15 P.TL All members present, <br />Hearing had on Vacation Resolution No. 108 for -the Vacation of Brook <br />In the above matte remonstrators appeared but no written remonstrance <br />was filed. Atty, May representing property -owners and Atty. John Yeagley representing <br />New York Central Railroad Company appeared and resolution modified as follows, -- <br />Commencing at a point 260 feet west of the west line of Miami Street <br />running on the north line of Book Street; thence south crossing Brook Street to the <br />north line of the right of way -of the New Ygrk Central Railway Company; thence west <br />o the liorth line of the New Yo;k Central Railwag right of way and the south line of <br />Brook Street 109 feet to the east line of K:?�eighbaum Park as conveyed to�the City <br />oT-L�outt Bend, Indiana, running thence no rth on the east line of said Park to the port <br />line of Brook Street to the place of beginningg and as modified resolution is in all <br />things ratified, confirmed and approved. <br />u3 <br />The Board now orders that a list or roll be prepared of all owners or <br />holders ofmpropbrty and of valuable interests therein sought to be taken or to be <br />injuriously affected which list or roll shall also describe the property beneficially <br />affected. <br />` Hearing had on roll of awards of damages and assessments of benefits <br />for the 0ening of Harriett Street from Mishawaka Avenue to North line of Grand Trunk <br />Testers R ilroad Company under Imcation Resolution No. 96. <br />In the above matter no remonstratora appeared and no written remon- <br />strance was filed. The Board therefore declare the above roll filed December 23rd., <br />1925. ( See files for <br />copy of roll.). <br />Hearing had on roll of awards of damages and assessments of benefits <br />for the Vacation of Street and alleys in Beyer's 2nd. Addition under Vacation <br />Resolution No. 103, <br />In the above matter remonstrators appeared and no written remonstrance <br />was filed. The Board therefore declare the above roll filed December 16th., 1925 <br />in all things ratified, confirmed and approved and the proceedings closed. ( S.ee files <br />for copy of roll:) <br />Partial estimate for sewer on King Street from Portage Avenue to a point <br />100 feet west of the west line of Anderson Avenue, under Improvement Resolution No. 155d <br />allowed to John Lugaresi for the amount of 01,481.81 <br />i - <br />The City Engineer submitted thevlist of property owners -in the matter of t <br />i e appropriation of certain property under Condemnation B.esolution N . 95 for the <br />�ningyof Streets and alleys in Charles Weidlgr's 2nd. A�ditiion and°Studebaker's <br />lace A.1jition, <br />inn <br />Which list includes the names'of the owners and holders of property <br />and its interests therein sought to be taken or beneficially or injuriously affected, <br />and the description of the several pieces•of property which is affected by the said <br />appropriation proceedings. <br />h <br />Thereupon the Board proceeded to award the damages sustained and to <br />assess the benefits accruing to each piece of property upon said list. <br />It was thereupon, upon motion duly made and seconded and unanimously <br />adopted, resolved that said list,.together with the amounts of benefits and damages and <br />net benefits and net damages therein set forth as to the several parcels of land be <br />adopted and that the respective amount of benefits contained in said list be and are <br />hereby assessed against the several tracts of land as specicially set forth in said list <br />and that the respe ctive amounts of damages contained in the said list be and are hereby <br />awarded to the several tracts of land as specicially set forth in said list, and that <br />net benefits or net.damages, as the case may be as to the respective tracts of land, <br />contained in said list are hereby awarded or assessed, as the case may be as to the said <br />several tracts of land. <br />The Board hereby further sets off the benefits and damages each against <br />the other where both benefits and damages are assessed, against the same piece of proper <br />;tract of land or interests, and hereby fixes the said respective net benefits,as the <br />amount that shall be paid by the respective owners as benefits, and further hereby fixes <br />them respective net damagew as to the several tracts as the amount that shall be paid <br />to the owners of the respective tracts as damages. <br />Thereupon, upon motion duly made and seconded and unanimously adopted <br />the date not set for hearing on roll, <br />the list of property owners in the matter t <br />T e Cit y E ngineer submitted <br />
