MEETING -- NCUr'1v1.BER 18, 1940 571 respectively, and being now 10:30 A. M. on November 18th, and no remonstrances having been filed with the Board and no one having appeared in opposition to said resolution, it was moved, seconded and unanimously carried that the resolution #2503 vacating said alley be finally adopted and.said alley be vacated. The Engineering Department is directed to prepare an assessment roll covering the benefits and damages to the surrounding property. WHEREAS, Irene M. Redden and Earl J. Redden, her husband, of St. Joseph County, Indiana do hereby grant to the City of South Bend, Indiana or its successors, the right to lay, maintain, operate, alter, repair and remove a sewer, together with all manholes, • structures, pumping stations and appurtenances connected therewith, by an easement thru and over the following described real estate, to -wit: Beginning at a point on the East boundary of Lot 13 in Major's Addition to the City of South Bend, 245 feet North of the South- east corner thereof, thence North 410 43t 'Nest, 26 feet more or less to the low water mark of the St. Joseph River, thence North- easterly along the St. Joseph River to the East line of said Lot 13, thence South along the East line of said Lot 13 to the point of beginning. NOW, THEREFORE: Be it resolved by the Board of Public Works and Safety of South . Bend, Indiana, that said easement is hereby accepted and approved by said Board for and on behalf of the City of South Bend, Indiana, and that said easement be entered upon the records in the Recorderts Office of St. Joseph County. Said easement may be found in deed record _y_.g_ on page�5 • • • WHEREAS, Playland Park, Inc., and the American Trust Company of St. Joseph County, Indiana, do hereby grant to the City of South Bend, Indiana or its successors, the right to lay, maintain, operate, alter, repair and remove a sewer, together with all manholes, structures, pumping stations and appurtenances connected therewith, by an easement thru and over the following described real estate, to -wit: A part of the unplatted land in the City of South Bend,.Indiana, bounded on the North by the St. Joseph River, and on the East by the South Bend City Limits, and on the South by the North boundary of Lincolnway East, and on the West by the East boundary of Lot No. 13 in Major's Addition to the City of South Bend, Indiana, which part is descried as follows: Beginning at the Southeast dorner of Lot 13, Major's Addition to the City of South Bend, Indiana; thence North along the East line of said Lot 13 to the low water mark of the St. Joseph River, thence in a Northeasterly direction along the low water mark of the St. Joseph River to a line 16 feet East of and parallel to the East line of said Lot 13 in Major's Addition to the City 6f South Bend; thence South along said line 16 Feet East of and parallel to -the East line of said Lot 13 to the North line of Lincolnway East, thence Northwesterly along the North line of Lincoln - way East, to the point of beginning, all in the City of South Bend, St. Joseph County, Indiana. -NVYV, THEREFORE: Be it resolved by the Board of Public Works and Safety of South Bend, Indiana, that said easement is hereby accepted and approved by said Board for and on behalf of the City df South Bend, Indiana, and that said easement be entered upon the records in the Recorder's Office of St. Joseph County. Oliver of South Bend, Indiana was the grantor, releases and Quit -Claims to the Municipal City of South Bend, Indiana, the following described real estate to -wit: The East portion of Webster Street from Bruce Street to Donald Street, more particularly described as follows: Beginning at the intersection of the Nest 1/8th North and South line of Section 14, Tovmship No. 37 North, Range 2 East with the South line of Bruce Street; thence East along the South line of said Bruce Street, a distance of 30 feet to a point, thence South along a line 30 feet East of and parallel to said West 1/8th line of Section 14, to the North line of Donald Street: thence West along the North line of Donald Street, 30 feet to said West 1/8th line of Section 14, thence North along said West 1/8th line of Section 14 to the South line of Bruce Street, the place of 'beginning. for the purpose of opening Webster Street, between Bruce Street and Donald Street in e City of South Bend, Indiana. NOW THEREFORE, be it resolved by the Board of Public Works and Safety of South Bend Indiana; that said real estate is hereby accepted and approved by said Board for and on behalf of the City of South Bend, and that said deed be entered upon the records in the Recorderts Office of St. Joseph County.
