<br />respectively, and being now 10:30 A. M. on November 18th, and no remonstrances having
<br />been filed with the Board and no one having appeared in opposition to said resolution,
<br />it was moved, seconded and unanimously carried that the resolution #2503 vacating said
<br />alley be finally adopted and.said alley be vacated.
<br />The Engineering Department is directed to prepare an assessment roll covering the
<br />benefits and damages to the surrounding property.
<br />WHEREAS, Irene M. Redden and Earl J. Redden, her husband, of St. Joseph County,
<br />Indiana do hereby grant to the City of South Bend, Indiana or its successors, the right
<br />to lay, maintain, operate, alter, repair and remove a sewer, together with all manholes,
<br />• structures, pumping stations and appurtenances connected therewith, by an easement thru
<br />and over the following described real estate, to -wit:
<br />Beginning at a point on the East boundary of Lot 13 in Major's
<br />Addition to the City of South Bend, 245 feet North of the South-
<br />east corner thereof, thence North 410 43t 'Nest, 26 feet more or
<br />less to the low water mark of the St. Joseph River, thence North-
<br />easterly along the St. Joseph River to the East line of said
<br />Lot 13, thence South along the East line of said Lot 13 to the
<br />point of beginning.
<br />NOW, THEREFORE: Be it resolved by the Board of Public Works and Safety of South
<br />. Bend, Indiana, that said easement is hereby accepted and approved by said Board for
<br />and on behalf of the City of South Bend, Indiana, and that said easement be entered
<br />upon the records in the Recorderts Office of St. Joseph County. Said easement may be

<br />which part is descried as follows: Beginning at the Southeast
<br />dorner of Lot 13, Major's Addition to the City of South Bend, Indiana;
<br />thence North along the East line of said Lot 13 to the low water mark
<br />of the St. Joseph River, thence in a Northeasterly direction along
<br />the low water mark of the St. Joseph River to a line 16 feet East
<br />of and parallel to the East line of said Lot 13 in Major's Addition
<br />to the City 6f South Bend; thence South along said line 16 Feet East
<br />of and parallel to -the East line of said Lot 13 to the North line of
<br />Lincolnway East, thence Northwesterly along the North line of Lincoln -
<br />way East, to the point of beginning, all in the City of South Bend,
<br />St. Joseph County, Indiana.
